can someone draft a template like the nurses letter to congress for us with subject "Please provider retrogression relief for Employment Based Immigrants." and the body of the letter with the provisions and proposals including "recapture of unused visas". I feel the nurses will deplete our unused visas by recapturing unused ones several times and we may not have that option anymore.

Can we each leave a 'personalized note' on how much we have contributed in Federal / State / Social Security taxes + Medicare / etc.???? Even a rough order estimate... to get them to listen to us seriously.

1. State-wise, collect estimates of taxes paid till date
2. Collect the data (anonymously, of course) and send a written brief to each Senator in that state - making a clear economic case to how we contribute
3. Collect the data (nationally, with statistical analysis thrown in) and send a written brief to all Senators - making a case at a national level.
We need eye-popping numbers, charts and quotes ... to continue the PR around high skilled immigrant needs.

Now the country limit rule applies only to EB3-I and EB3-C.
Since EB2-ROW is always current, all the spillover goes to EB3-I/C and so they are not affected by per country limit rule.
EB3-I is the only sufferring category. Guys, we have to do something. Any suggestions on how to voice our concerns?

I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Lets move on and focus on this main topic...
Here are my observations.. Correct me if I am wrong..
1. L1 option for IT is essentially killed
2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.
3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.
4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.
5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.
6. Need more clarity on where H1B outsourcing will be stopped...
Good recap. This bill is not about liberating employees. This bill is to kill H1Bs and L1s irrespective of whether the company is a consulting company or a direct employer.
Net result ? more outsourcing. Big outsourcing firms have enough experienced employees on their payroll to do outsourcing effectively.
If this bill passes, it will be a shameful day for USA.

Changed Employer in late 2004 and filed for GC. So my priority date is early 2005. Old Employer did not file GC so forced to leave him.
Now in retrogesstion. Employer takes lot of his share in the billing rate. If we need to go for a good billing rate, vendors think I'm new to US as I don't have GC. Lot many Dependents after getting GC started working and so supply for software professionals are more. Demand meets the supply and so the billing rate is down. Most of the vendors prefers only locals. Forced to take job whatever comes first.
Have a grown up child and she has to start his school. Well educated wife not able to work and wasting time and energy. Not able to decide other than being in US. Keep reading the forums and whenever some bill comes up hope rises, but all now in vain. From now will not expect or believe anything from US congress/senate until President signs it.

...but remember it can be pure coincidence that your letter to 1600 Pennslyvania made any difference. Moreso when the namecheck and the approval..all happened within 2 weeks of the letter !
Anyways no harm trying any and all legal ways !
You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

Isn't H1B renewal more risky than I-485 as for H1B you have to worry about more things like, Prevailing Wages, LCA, Ability to Pay and even from the cost point of view for H1B most likely you will need a lawyer whereas for EAD/AP it is doable on your own?

Couldn't agree more. The problem lies here in the US..Just pure politics...The cost of education is just too high for an american to get a degree whereas a foreign born is able to get it for cheap. Politicians know it and they want to keep it that way. America will just do fine with or without you.

What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
If one shows more loyalty than that shown by that entity, then one is a fool. That entity could be a country, party, company, spouse.
Right now, one entity (US government) is not showing much interest in our condition. That level of loyalty should be reciprocated but no more.

Eb3Nepa is very much here from initial days of this organization and supported the cause alot, even more than main members(So called..) here.
That is how he knows the core team members names/handles, even lot of you do not know them...
Only 1 or 2 members are here from initial 12+ core members..That is another thing though.
Anyway, as others mentioned, people have to move on..and this movement is just not by core members but by all. Core members comes/goes, after their journey, unless they have some agendas. (In the +ve way)

Does it matter whether the 485 is employment based or family based? I have a valid H1 (not stamped) and have just applied for adjustment of status (based on marriage to a USC) and AP. When I return from the planned travel, can I continue working for the company that I am currently employed with?
My H1 is valid until Q3 of '09.
