To me; it looks like it could be a shift in change of policy. In the denial notice; it is the same officer number who sent the notice of intent to deny. Therefore; it is not a training issue; looks like something else is happening.
training issue is when they send straght denial after 140 is revoked.
Can you upload the denial notice - off course you can erase the confidential information. It will be useful to us.

They moved from 8/1/2002 to 9/22/2002.
According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
Never mind the spillover, can ROW just get its normal quota at least?

I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.
Is it just my wishful thinking?
As for masters, are you persuing MBA? How about PMP?
I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.

Again, if you just filed 485 a few weeks ago, you cannot call yourself "stuck"!
I don't think a Mandamus can be considered until the NC has been pending for a very minimum of a year.
Saying that, in case someday you would be in a situation where you would have no more choice but file a Mandamus complaint, yes you can do it by yourself.
Go to the beginning of the thread "FBI name check victims" and browse through the posts, someone explained how to do it.

Indian insurance companies that process through "Corus" in France are all SHAM policies. In the event of any claim, they try to wiggle out stating there was some preexisting condition.
While it is understandable that no insurance will cover preexisting conditions, New India Assurance and other jokers that process through Corus are out there to lie, cheat and steal.
Stay away from those sharks and get a US based insurance, if you can.

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

Sending letters is a waste of time. I did many in the past and nothing happened. We will only make post office richer and lose money on postage. Nobody reads or replies to letters.

"...Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.
....Just be careful with the idea of "demanding" and "rights" though :)

I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."
Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.
And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...

We are really now in a global credit/liquidity crisis. Please see the link below to see the cash crunch the major real estate players like DLF are in. This article is from July so you can imagine what September would have been like for them. Prices have already come down in major centres. Currently there is a game of chicken being played between builders and end use buyers. Every indication is that very soon builders will have to cut their losses and sell their flats at deep discounted prices.

As per my attorney (one of the top 3 in the country), there is already more than enough proof of rejection, which means an actual rejection package is NOT needed at all to proceed with Class action law suite
Example is revised visa bulletin, and that IS sufficient.
Infact, i tried to get some info, but all i got was "something favourable might happen ". That's a very generic statement and means nothing according to me.
It very well could be deliberate, no rejection notices mean, the lawsuit will be weak.

I know you are a committed member and you contribute as well. You have been helping the holiday thread to be on the top too. I was talking about my IV holiday fund raising to one of my co-worker who is a US citizen and who does not have an Indian/ Asian ethnic background and he had mentioned to me you guys are 25,000 people and all of you are hard working legal immigrants. you dont need to go to anyone else for money. your group is financially very strong. If all of you put in 10$ each month you will have 250K funds available every month. What you should really work on is get every member to commit to that 10$ every month. What can we do to get every one of us put in that 10$ every month?
I have read my post couple of times before posting to avoid any mis-communication...but it's never possible to prevent I believe:)
I have a recurring contributions setup and also contributed what ever I could this holidays...probably will contribute more before the end of the season. My post is not about the Monthly contributions made by you, me or many others...who signed up.
It's about the ones' who cannot for what ever the reason may be....you and me pointing to the salaries or house-hold incomes will not help them join the wagon.
It's about increasing the donations irrespective of people joining the monthly-contributions scheme....Other viable options...may be having a IV donation boxes...in immigrant owned businesses....etc.
In an ideal world as you mentioned atleast 20000 of 25000 will contribute monthly....It's defintely good to aim for that....but that's not realistic.

H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

I think we should create a separate section/webpage and list all the members who have contributed 100$ or more. This might encourage others who have not contributed, to contribute. Also, this might encourage people who have contributed less than 100$ to contribute atleast 100$ and see their names in this special recognition section (not to mention the immense help they would do to the IV goal of 150K by may 1st).
Just a thought.

I am not sure whether it is name check or something else. Service rep at infopass told me background check has not come back. I have another appointment on Wed and will try to find out which part of background check is pending. Is there anything IV can help me if it happens to name check?
