Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

There is no point in sending flowers knowing nothing gonna change. it is like putting flowers to us.
Everyone has a different reason for doing this. I for one do not believe, this will give us any interim benefits. But Iam here for the long haul (2-5 years). I know that if we need to fix the system (get visa cap raised), we have to start somewhere. This will, hopefully get some conversations started in the media/congress. Who knows, this along with other initiatives that IV is undertaking/undertaken along with industry support, we might get it done in a few years.
If not, atleast I would go to bed thinking I tried...

I thought I will share this. Not sure if its going to help anyone.
Approached the entry counter where they give you token to inside and talk to IO. Surprisingly the person at the entry counter had IO written on her badge that she was wearing. She asked me reason to visit. I told her that I applied for my I-485 and have been current for this month , but have not heard anything. She asked if I was EB2 or Eb3. I told her EB2. She asked for receipts. I gave her 485 receipt and copy of I-140. She then compared my PD with copy of August Visa Bulletin. After she confirmed that I was current, she told me that my case is assigned to IO. I don't think she even entered my A# or receipt number. But I am not sure about this part because I dont remember the exact sequence of events. Anyway, I asked her whether my NC is clear. She then entered something in the system and told me that my NC was clear only last month and thats why my case has assigned to my IO. But this time she told me it was assigned on 8/8/08. She told me I should hear something soon. Did not and was not ready to give any time line. Also she did not mention anything about visa numbers being exhausted. If this had been the case she could have mentioned that.
After that I asked if everything else was clear, she mentioned without even looking at the system that everything is clear and I should hear on my case soon.
I dont know about rest of the stuff but I know that at least the NC info is consistent with the call I made to TSC few weeks ago. So I can at least believe that my NC is clear.

I think comparing both these data I can approximately say 90,000-100,1000 EB2 labors have been cleared in 2004 and 2005. That is like 2 lakhs applicants including primary and derivative applicants. Even if we put a 50% error margin thinking that there were more Eb3 labors, 140's are denied or downgraded to EB3 or a problem at 485 stage there are 1lakh - 485 applicants including Eb2 and EB3 waiting for 2004 and 2005. With a per country quota of 3800 + a bit of row how many years will it take to come to 2006 - where a lot of Eb2's are stuck?
I think it will take 10 years for a EB2 2006 applicant to get his physical green card including 485 waiting time etc.

I'm curious if the POE officers know if a person has been laid off? A friend of mine is planning to travel to Canada for the first time. He has an H1b for the past 6 years and approved I-140 and extension. He was laid off for 5 months from Company A but has an approved extension for Company B. This was 4 years ago.. His been working for company B eversince w/o problems.
His worried about traveling. His planning to use Auto Revalidation with his B1 visa. Can somebody advice?

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

Due to this my approved labor went down the drain. I moved to the state of the head office, meanwhile my company off-shored a major portion of the development office where I was working early 2005. After much persuasion from me the filed again but I had to either move offshore or take up a 90% travel job with the same company. Now, I travel and am away from my family during the weekdays. I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?
With the retrogression my GC could take years....sometimes I wonder if the stress, living in constant fear not knowing what is going to happen tomorrow, staying far away from loved ones, all these sacrifices is really worth it when legal workers like me who have contributed to the economy of America seem to have no value in this country.

I never claimed any amount for this holiday gift on this thread yet but what if I want to donate $31 or per say $ 81 one time, I do not have that option now and so I will end up not donating now and wait and donate when I feel comfortable with $ 100/- or its multiplications. That is called turning away and if you guys do not see any danger into it I do not have any further words.
Fund raising is an art and I believe our current startegy is lacking that art. If you guys see the base of any major successful fund raising (Grass root level not Political ones, mind well we claim ourselves grass root level organization)you will always find donors with $ 1 to donors with $1 million donatiing as per their will. Grass root level fund raisings can not afford constraints which normally goes successful in political and/or industrial fund raisings.
Some of the strong supporters of current policy, in their argument, automatically assume that willing donor always used to spend $ 100/- frequently for drinks or food and may be living lavish life style. But they are partly wrong in their assumption...I myself never eat outside frequently. Even on a travel trip I cook my food by myself and I normally do not drink sodas or alcohol so what abhijitp has given a example at least does not remain valid for me but I can not say that it is completely out of proportion, as it has some valid logic but it can not be true for everyone.
Point is if we make a wrong based fund raising policy, we may hurt ourselves only. I know my option, if I want to donate odd figure now, I will not be able to donate it now, and I will have to wait till I feel comfortable donating $ 100/- and/or single digit multiplications of $ 100/- but would that be considered a good and wise option?
For an example, I am emotionally charged today and I want to donate $ 61/-(As I may plan that much only..for whatever reasons) but I am not able to donate so I will not donate and say after 4 months I will be able to plan $ 100/- but what if at that time I may not be emotionally charged to donate all together? So end effect would be I will end up donating nothing ( This is just an example..:))
And for the sake of argument if you enrolled yourself $50/- recurring, you did it willingly and so would you change to $ 25/- recurring if $ 25/-option is available to you? (Note: I think most people on this board fear that with having a minimum amount option, most people will turn to that only but that may not be 100% true. and even if it may become true it will end up having more donation flow) For most people answer is no, I believe, They will stick to $ 50/- recurring option as they can afford and they did it willingly. But with current policy we are completely turning away the people who may otherwise donate, for an example $ 20/- monthly-recurring policy may turn 40 new commited donors in whereas $50/- recurring option is creating only 10 donors and thus we may be ending up $ 300/- confirmed donation loss per month. This is just an example and based on assumption that less amount would attract more commited donors.
Having said all this, if majority memebrs and core still feel that this will be the only future standard for accepting donations then as I mentioned above, I will have only one option left and that is to wait till I become comfortable for donating $ 100/- ( I will remain emotionally charged...:))

1) Paskal has already suggested how you can donate an odd figure with a personal check... it is a matter of time.
2) I think you can paypal whatever amount you want to IV using PAYPAL. You just need to know the email address of IV, as registered with paypal. I just sent you a PM, please check.
3) For the latest event conducted by North California chapter, we were accepting ANY amount for a contribution. I repeat, ANY amount. Would you like to know how many folks contributed in the end??
4) You are missing the point about expenses on gas/ food/ drink. Actually I have no business asking anyone to stop eating out (I know I love to do it every once in a while:))
My point is, you make no investment in your own quality of life when you do it. So why not invest some amount every month in your own future?
Do you think things will somehow miraculously change and get you your green card faster?
Would you also please note that some folks are working tirelessly and/or contributing regularly even as those who will benefit much sooner than themselves from this effort, choose not to pay even $10 a month to sustain this kind of a mammoth effort?

Another member from CA has joined this challange. The member has contacted me and I have just now spoken to the member. The member wants to stay as an annonymous donor. So far he has contributed $1500 over the past few months.This member has pledged to pitch in with some more money when the total contributions from other members reach the 30,000 & 60,000 dollar mark. This is not same as revoking all substituted labors. This is simply rearranging the serial numbers in the queue. And this does not require any law from the lawmakers. So this should be low hanging fruit.

please refer the dates before posting such useless information. very ashamed to see some donors do this kind of mistake. unnecessarily misguiding the people. for a moment i lost hope. if this time, the uscis (after all the preadjudication numbers and all) makes this kind of stupid mistake then the USCIS should be ashamed of its existence and DHS should shove its head in some uselss thing.

I am not trying to scare you, far from it I am trying to make sense of conflicting reports we keep getting from uscis and visa bulletin. AS ron gotcher says the oct bulletin will complete the picture.
