Since then, the Beijing-born Li's career arc has been so steep it gives her peers vertigo.
She's had stories published in prestige magazines such as the New Yorker and the Paris Review. She's won the Pushcart Prize and the Plimpton Prize for New Writers. Random House has signed her to a $200,000, two-book contract, which Executive Editor Kate Medina calls -- in what qualifies as a serious understatement -- "most unusual" for a literary writer at this stage of her career. Her first book, a story collection called "A Thousand Years of Good Prayers," was published this fall to wide praise.
Now she has another problem: How do you explain to the federal immigration bureaucracy what the word "extraordinary" means?
n the summer of 2004, Li petitioned the U.S. Citizenship and Immigration Services to become a permanent resident of the United States. To approve her application for a green card, USCIS would need to agree that she was an artist of "extraordinary ability," defined in Title 8, Code of Federal Regulations, Part 204.5(h)(2) as "a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor."
To the upper echelons of literary publishing, Li looks like a slam-dunk to meet this definition. Not to the USCIS, however. A year after she filed it, her petition was rejected.
She has appealed. A USCIS spokesman says she is likely to get her answer in a few weeks.

Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?

Hi, I have a question regarding the exempt cap for non profit H-1. I will graduate with a masters in education in 2008 and already have job offers to work in public schools.
My question was -
- does public school employment qualify under the non profit H-1B exempt category?
- Should I apply under the Masters quota?
Please reply as I have been searching for answers for a few weeks....

H-1B for secondary public schools does not qualify for the non profit H-1B exempt category. But since you have a Masters from the US you will fall under the 20,000 visas slot. Your employer will not have to pay for the H1B training fee of $1,500 at the time of filing. Good Luck!

I was wondering why is it that you have so many red dots and so disliked in IV and your response below answers that question. You are a mischief monger who want to mislead people. The issue was never about which is better eb1 or eb2 or eb3, the answer is eb1 is better than eb2 and eb2 is better than eb3. The issue is how easy is it to port to eb2, infact if porting to eb2 was that easy everybody would have already done that. nobody is sponsoring green cards in this economy not even eb3 forget about eb2, not even desi companies are sponsoring eb3 perm petitions. In this age when there are reports that USCIS is sending out invistigators to look into even ac21 cases you are misleading people into porting from eb3 to eb2. Forget about porting as no one is even sponsoring eb3 perm.
As slim a chance as it is, visa recapture or some administrative fix like a remporary green card or relaxation of ac21 regulations like same semilar job restrictions is our best bet.
Eb2 will be better most of the time because many will not be eligible or Job position does not need Masters or 5 years of experience. So it will move fast though it may go back on october. So if possible try to port into EB2 will always be a good idea. CIR or Visa capture bill may not be possible atleast for an year or more. EB1 and EB2 are best bet for next 1 to 2 years.

Everybody who reads this thread should either donate themselves or if they have already done so, then make sure you talk to a friend and convince him/her to donate. You are not doing any public service by donating to IV (nothing wrong with those kind of donations). Whatever you donate will actually come back to you as a benefit you really want and in a much bigger multiple.

Changing F1 to GC law to make it legal has as much chance as getting law change to not include dependents. I would rather support the latter then support F1 to GC law change
I do look beyond my own situation and thats why i support current spillover rules and filing 485 without current PD issue even though it does not help me directly in any way what soever and if fact is dterimental to my EB3 case.

Plainspeak...no one here knows everything abt immigration. so its ok that u lost this argument. we are here to share out experiences, enlighten each other, and work for easing EB backlogs.
