Presidential War Powers

Harry Reid's a blithering idiot. I have no idea how he was ever elected to public office. It's not so much his position on the War Powers Resolution, but that it's at odds with his claim that the public wants the troops home from Afghanistan. Frankly, Americans are weary of overseas commitments altogether, but at least the Afghan deployment enjoyed broad bipartisan support to begin with, back in the day. With Libya, the administration took the easiest route to do something --- anything --- in North Africa and the Middle East amid the wave of revolutions taking place in the "Arab Spring." And there's been little public consensus on major U.S. role in Libya.

Unfortunately, a Ron Paul wing in the GOP is joining with the Dennis Kucinich Demo-nuts to push for action on the Resolution. A lot of folks in the right blogosphere have made something out of this as well, and it goes to the lack of vital national interests at stake, and that's understandable. That said, John Yoo's got a new piece up on the Commander-in-Chief's authority on the use of force, "The GOP Plays Politics With the War Powers Resolution," and Yoo's the man:

Congressional Republicans should not try to outdo Mr. Obama in a game of unprincipled one-upmanship. But that's precisely what key GOP leaders have done. Earlier this week, House Speaker John Boehner sent a letter to the White House accusing Mr. Obama of violating the War Powers Resolution. "The Constitution requires the president to 'take care that the laws be faithfully executed,'" he wrote, quoting the president's responsibilities under Article II of the Constitution. "And one of those laws is the War Powers Resolution, which requires an approving action by Congress or withdrawal within 90 days from the notification of a military operation."

Mr. Boehner's claim ignores the Constitution's fundamental nature as supreme law. As Chief Justice John Marshall declared in the foundational case of Marbury v. Madison (1803), the Constitution is "a superior paramount law, unchangeable by ordinary means," and any act of Congress "contrary to the constitution is not law." If the Constitution gives the president the executive authority to use force abroad, Congress cannot take it away. Surely Mr. Boehner agreed with this proposition before the current president took office. He, for instance, never claimed that President George W. Bush's exercise of broad executive powers in the war on terror violated the Constitution. Nor does he appear to have thought that legislative authorization of the Afghanistan and Iraq wars was constitutionally necessary in 2001 and 2002.

Not to be outdone, House Republicans Roscoe Bartlett, Dan Burton, Howard Coble, John Duncan, Tim Johnson, Walter Jones and Ron Paul joined with Dennis Kucinich and other Democrats this week and filed suit in a D.C. federal court seeking to halt U.S. military operations in Libya. They may see themselves as purists, but they are not demonstrating fidelity to the Constitution by launching a legal effort that they know to be utterly futile ....

The same congressional panel that launched a preliminary inquiry into Weiner-gate this week has been diddling around with several other Democratic ethics scandals for years. These aren’t foxes guarding the henhouse. They’re sloths guarding the foxhole.

The House Ethics Committee is now reportedly probing into Twitter-holic Democratic New York Rep. Anthony Weiner’s possible abuse of government resources while sending pervy messages and photos to young women across the country. The latest batch of Weiner’s leaked social-media self-portraits — more cheesecake than beefcake — showed him in various states of undress at the congressional gym. From what other public buildings has Ick-arus tweeted his junk? And how much time on the public’s dime did his government staff spend coaching Weiner girls to assist with damage control?

Don’t expect an answer from the House ethics watchdogs until after Weiner’s first child enters kindergarten. The wheels of justice grind more slowly there than a dial-up modem.

Congressional lawmakers' financial-disclosure forms for 2010 were released on Wednesday, and Weiner's lists investments in a range of companies--including Hewlett-Packard, Corning, 3M, Dow Chemical, and Sony--that are worth as much as $117,000.

And he would clearly be better off if the scandal doesn’t also cost him his wife, Huma Abedin, an aide to Secretary of State Hillary Rodham Clinton. The filings show that Weiner, 46, has an investment portfolio worth $16,017 to $117,000. His financial activity for 2010 involved buying into and unloading a number of companies, including the purchase of an interest worth $1,001 to $15,000 in Live Nation, the live-entertainment and e-commerce company.

MediCare: Too Good to Last

“Social Security and Medicare Taxes and Benefits Over a Lifetime,” a study by C. Eugene Steuerle and Stephanie Rennane for the Urban Institute that was released in January, demonstrates quite vividly why senior citizens like Medicare so much. A single man earning the average wage, $43,100 in 2010 dollars, who retired in 2010 will pay an average of $55,000 in Medicare taxes over his lifetime and will receive $161,000 in Medicare benefits. A similarly situated woman will pay the same $55,000 in Medicare taxes but will get $181,000 in Medicare benefits (because women live longer than men). A one-earner couple in that situation, again paying $55,000 in Medicare taxes, would receive $342,000 in benefits. If you’re a Medicare recipient, why wouldn’t you think that the program as we know it is a great deal?

But, obviously, it’s not sustainable. With federal budget deficits soaring and worries about a national-debt crisis in our future rising, how is it possible to keep Medicare as we know it? If the federal government, over the long haul, isn’t in a position to make up the gap between what people are paying and the benefits they’re receiving, Medicare taxes have to go up, benefits have to be cut, or deductibles have to be raised on high-income retirees.

That's the key nugget, but read it all. Democrats are getting a free ride on this politically, despite the fact that the GOP's got the honest approach to policy. As usual.

Gabrielle Giffords Struggling to Communicate

It's a miracle she's alive, but still, this is sad news for those who hoped and prayed for her return to public life. At LAT:

Gabrielle Giffords is nowhere close to returning to Congress. And there remains real doubt about whether she ever will.

That appears to be the bottom line of an article Thursday in the Arizona Republic that provides the most complete assessment yet of the wounded congresswoman’s current condition. Giffords was shot in the head by a gunman in Tucson in January. Now, six months later, she still struggles mightily to communicate, although her staff believes her comprehension skills are strong. And it remains unclear just how much damage her brain has suffered.

Asked for a blunt description of Giffords’ condition, her chief of staff, Pia Carusone, replied: "She's living. She's alive. But if she were to plateau today, and this was as far as she gets, it would not be nearly the quality of life she had before."

As to whether she resembles herself before the shooting, Carusone said, “There's no comparison. All that we can hope for is that she won't plateau today and that she'll keep going, and that when she does plateau, it will be at a place far away from here."

The news may be sobering, but it's not necessarily a surprise. The state of Giffords' health has been closely guarded information as early, hopeful accounts of her rapid physical and motor recovery yielded to more cautious -- and less frequent -- reports. She remains at a Houston rehabilitation facility while her staff manages her day-to-day congressional business.

Although her two trips to Florida to witness the launch of her husband’s space shuttle mission were hailed as significant milestones, she was kept from the public. No photo of her after the shooting has yet been released, but Carusone said that day is coming.

A Short History of Political Suicide

Woodrow Wilson's most famous piece of political advice was "Never murder a man who's committing suicide." Rep. Anthony Weiner's critics might keep that in mind. The Twitter disaster has undoubtedly ended his hopes of being New York City's next mayor and may well cost him his seat in Congress.

But as a scandal it pales before Eliot Spitzer's descent into political infamy when he was identified as being "Client No. 9" in an upscale prostitution ring. Within a week there were T-shirts for sale proclaiming "I'm Client No. 8!" and he was forced to resign as governor of New York. As he drove to make his resignation announcement, his car was tracked by helicopters through the streets of Manhattan like O.J. Simpson's famous ride in a white SUV through Los Angeles.

Rep. Vito Fossella of Staten Island (is there something in New York's water?) was arrested for drunk driving in Alexandria, Va., in 2008 and among the revelations that flowed from it was the fact that he had a 3-year-old daughter with a mistress. He declined to run for re-election. Then there's former senator and vice presidential candidate John Edwards's love child, the cover-up of which has now gotten him indicted. Whatever the outcome of the case, his hopes of being president are a distant memory.

'Room for Debate' — Can Weiner Survive?

That's survive electorally. Whether his marriage survives is another question.

At New York Times, "Can the Democrats Keep Weiner's Seat?" An interesting panel of debaters, but I like Kay Hymowitz, "Parochial, Not Puritanical":

Will the people of New York’s Ninth District give their disgraced Congressman, Anthony Wiener, the boot? On the face of it, it seems they will – and hard. The bizarrely shaped district, designed to facilitate the election of black leaders in an adjacent area, is largely white and ethnic: Italians, Irish, and Jews, not Upper West Side Jews mind you, but Orthodox and Russian immigrant Jews.

In fact, the Ninth seems to be among the last of 20th century ethnic enclaves in the outer boroughs. And as everyone knows, that crowd tends to be socially conservative, anti-abortion, anti-same sex marriage, and, it would follow, more unforgiving of philanderers.

On closer inspection, however, a culture war-inspired ouster of the besieged Congressman seems unlikely. Yes, the district has trended more Republican in presidential races in the past decade, but that has more to do with 9/11 than with hot button social issues. The Irish of Breezy Point and the Rockaways like Weiner because of his support for the first responders; the Jews of Ocean Parkway are on his side because of his enthusiasm for Israel, which also explains why Chuck Schumer, no virtuecrat, retains a strong standing among his Orthodox constituents.

Remember also: white ethnics are no longer so predictably seeped in family values. A 2010 report from the National Marriage Project found a dramatic rise in single motherhood, cohabitation and divorce among the working class, which presumably would include many of Weiner's constituents.

And then there’s this: for Weiner to lose, someone has to win. But in the Ninth District, as in New York City as a whole, interests are parochial -- and the Republican Party, weak as a kitten.

Weiner Admits He Lied

The headline's long at NYT, "Weiner Admits He Sent Lewd Photos; Seeks Not to Resign." Just read the whole thing. Amazingly good piece. I especially like the suggestion that by the standards of Rep. Christopher Lee, who resigned from his own shirtless scandal, there's really no reason Weiner should stay in the House. And Nancy Pelosi's not pleased. She's promised an ethics investigation, and while normally that's a joke, I think Weiner's travails are hurting Democratic prospects for 2012, and they know it.

Obama Challenged on War Powers

He's getting hammered on this, and folks are talking about the introduction of ground troops. And Congress hasn't authorized the deployment? Obama's lame...

WASHINGTON — The House will vote Friday on two measures that are strongly critical of President Obama’s decision to maintain an American role in NATO operations in Libya, reflecting increasing disenchantment among elements of both parties about the United States’ involvement in the conflict.

The decision to put the resolutions to a vote came after Republican leaders earlier this week postponed consideration of one of them, which would direct the president to end American’s military involvement in the operations. It was sponsored by Representative Dennis J. Kucinich, the Ohio Democrat who is one of the most liberal members of the House.

The leadership feared that the Kucinich measure would pass with backing from an unlikely coalition of liberals and conservatives, a step they contended would send the wrong message to allies engaged in other conflicts with the United States.

On Thursday, Speaker John A. Boehner took the unusual step of presenting his own resolution to his caucus to be voted on by the full House on Friday, along with the Kucinich measure.

If either or both were to pass, it would represent the most assertive stance by Congress to date on the Libya conflict and highlight the chronic tensions between the executive and legislative branches over the president’s ability to wage war without Congress’s express approval.

Amazing. The deadline for congressional authorization was May 20th. This is an illegal war without legislative action. Even President Bush got approval for Iraq. Boy, that's some change.
