PRLog.Org) � Furore over the recent incident involving a volte-face by two US federal agencies - the Department of State and the United States Citizenship and Immigration Service, on acceptance of Green Card applications from eager highly-skilled professionals such as engineers, scientists, computer and healthcare professionals, has reached epic proportions.
Earlier this week, the agencies involved claimed that a communication gap and an overzealous attempt at reducing backlogs caused them to use up all available Green Cards for the current fiscal year by Monday, July 2, 2007, revoking a previous press release that they would honor applications through July 2007. The resulting discontent among applicants gained significant media attention across the United States and abroad, even striking a chord in Bollywood, the world�s largest movie industry.
This week, scores of highly-skilled professionals across various ethnicities and nationalities are sending flowers to the US Citizenship and Immigration Service in a symbolic act of "Gandhiism" or Gandhigiri, to demonstrate their displeasure and to request honoring of their Green Card applications filed in July.
In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."
The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.
Rajkumar Hirani, who has directed the Munna Bhai series, had this to say - "When you feel you have been wronged, you feel angry. The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. My well-wishes go out to these educated, highly-skilled professionals who have abided by the law and have been eagerly waiting in line for their Green Cards for nearly ten years."

Several applicants have had to call off vacations or business trips to be in the US to file �adjustment of status� applications as part of the final stage of the Green Card process. Some applicants or their representatives even traveled personally to Immigration Service Centers to be the first ones to submit. Not to mention the downtime that has resulted in lost productivity to several US businesses", says Aman Kapoor, of Immigration Voice. Aged parents and families in home countries were inconvenienced to source supporting documentation such as birth and baptismal certificates, all resulting in naught.
Although the ability to file for �adjustment of status� during July would not have granted the coveted Green Card, this move alone would have provided several interim benefits to qualifying applicants while waiting for their Green Cards- benefits such as the right to travel and right to work. Travelling via London Gatwick and Dubai to India and back. No airport change required during transit. Using AP, visa expired. I have a valid Canada PR card.
According to UK embassy US GC and Canada PR card holders do not need transit for direct airside transit. Does anyone have any experience in this situation? Please post.

The total number of applications excluding EB2, EB3 are 7,653.
The total visa's per annum -> 140,000
Considering that there would be more applications during the year from non-retrogressed countries/categories ..it is evident now that there won't be more than 5K such applications. On pessimistic side even if we consider 10K such applications, The visas available for retrogressed EB2 and EB3 should be around 120K this year.
Total pending EB2 is 74,932. So EB2 should be Current for all countries this year.
EB3 should get around 40K visas this year.
Any one disagrees?

I've been current since July, 2010 and got RFE on Sept 10, 2010. I don't have letter with me as yet to know about RFE.
Before REF, I waited for few weeks then tried followings:
1) Took infopass : Officer sent email to expedite.
2) Wrote to Senator: got reply they would get reply in 60-90 days
3) Sent an email via attorney to TSC: got automated response.
Then I got RFE after about 2-3 weeks of these attempts.

Hi guys
Just now (12.30 PM EST) I got a mail from USCIS saying your application has been approved. I didn't do anything (never opened SR or contacted Senator) but last week I did had an info pass appointment which was useless. MY PD was Feb 2005 EB2 INDIA (The fun part is My AP and EAD are still pending for over 4 months)

Right but the here problem is that how to come up with written evidence of discrimination? These jerks do not send you an email "Hey, we do not consider EAD". Their pattern is generally as under.
I understand. For an analogy consider theft. You might not know who did it but you lodge a complaint with the police. Its their job to investigate. Sometimes they are successful, sometimes they are not.
In this case if the govt gets lot of complaints, and find a pattern they will investigate and find the dirt.
All I and a few others are saying, discriminating EADs is illegal, and there is a govt. agency to deal with these things. So, if anybody is a victim contact the govt. agency. By being quite we are not helping ourselves.

Like everyone else i periodically come to IV and get to know the trends of whats happening. Thanks to everyone like qsek,teddy,vdlrao and many more who are contributing and trying to get some clarity into the backlog mess.
Having made a one time contribution was enough to get access to donor forum or so i thought. I really did not know that you need to have a recurring payment to get access to the donor forum.Most paid content websites may have that model but somehow I am uncomfortable with that idea here, and i am sure there are others who may feel the same.
Come up with a one time payment for one years access. It could be 300.00 USD to start with which is the same as 25.00 USD for 12 months which is the minimum you guys have set up. Many more will be comfortable with that.
Its just like rubbing me on the right side and you get my money ;), a trick which my wife exploits to the fullest :rolleyes:

OK, DOS buffer issue.
A. LAW. If there is no inventory in EB2 I/C (meaning demand). Theoretically DOS should make EB2 I/C CURRENT. DOS/CIS are not that dumb, or at least as dumb as before. I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
B. LOGISTICS. There could be denials, RFEs, although most (I believe almost all 100% pre-07/2007 EB2 I/C) should be pre-adjudicated now (THANK DOS CIS specifically did this so no processing time, and no waster numbers hopefully). That is why DOS has to consider that in their demand, and CIS has to consider that in inventory numbers
C TIMING. Charles is shooting a moving target as well (his job is not easy as he cannot predicate future 100% and has to follow law, and use all visa numbers, we should appreciate that). Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.
Approximately 2 months for PERM and then you can file 140+485 concurrently.

I am still trying to talk the old employer. Is it such a big deal that they cant even write a letter of future employment for me? i told them that they are not obligated to hire me but they are scared that they are trying to show that they are in losses and that by filing for a GC and promising a future employment they will not be able to show that they are suffering losses.
Why is it so difficult and complicated?
I am losing hope in it.

At last, after 10.5 years, 4 employers, 2 Labor filings, 1 Perm and 2 -I 140 (One from my employer and one from my spouse employer),1 - I485 filing, 2 SR, 1 senator request, 1 infopass - Got the mail - CARD PRODUCTION ORDERED for self, spouse and son.
What to do now? I dont know, for the last many years, used to think everyday about this 'CARD' and now nothing else to think about. May be, I should start thinnking about ????
But for now, Just going to relax and savor the moment.
Thanks for all the Guys, Gurus, Seniors, Juniors and all who contributed to the various discussions. I am pretty sure that I cannot stop logging to this website even I got my 'Card'. I will try to help you guys in some way or the other.

In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)

for those 39% the GC/Citizenship is denied? I haven't heard much about folks getting GC denied because of critical FBI report. The Ombuds is unable to determine how much of the 39% positive response cases were already covered by other means of check. .
I think their reasoning could be like this "Even if 1 million good guys are put to difficulty because of the false hits, if they can catch 1 bad guy with the process, they will continue to do so". The only solution appears to increase the resources/money.

Today I asked the customer service, they told me, I have to 315 dollars for annual plan. 239.99 + taxes = 315 dollars
Just pay $240 upfornt. I did the same. Now all the features of Vonage World for $20. :)
