Hi Friends,
I am a green card holder, becoming eligible for citizenship in April 2009. My fiance has been in the US for the past 2 plus years on F1. She completes her MS in December this year .We plan to visit our home country in August this year and get married. I thought this was a relatively uncomplicated case till I read in some forum recently that marriage to a permanent resident can be a barrier to being admitted to the U.S. in F-1 status. This is because such a marriage obliterates the "non-immigrant" intent required for F-1 entrants. This could very easily jeopardize her plan to re-enter in F-1 status.
Any thoughts or advice on this? Appreciate all the help.
Thanks a lot.

Answers:
1. Yes.
2. Yes.
3. No issues. You have approved I140, and using this you can get 3 year extension. But be careful to be discreet about the job change, because by any chance if your current employer revokes the I140, before your extension approval, you will be in trouble. (Because the basis for approval of beyond 7nth year extension is your approved I-140.)
1. Can I change my employer?
2. Can I retain my Priority date?
3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?

Dear friends,
Please be careful of corrupt attorneys and employers selling same labor to multiple candidates and making money by filing concurrent cases. I am happy that the substitution labor is dead which kills corruption by employers and attorneys. This is one of my bitter experiences with substitute labor.

did you get one? FP is necessary to the EAD
I filed EAD/AP and I485 together when I filed back in June 2005. I did not do any finger printing for EAD then. But for EAD renewal in 2006 and 2007 March, I applied EAD online. Then I had to go to ASC(Application Service Center) to give finger prints(not all fingers for EAD).
I'm one like you, check with your attorney for expert advice
PD : May 2002
Labor Certified : Mar 2005
I140/I485 concurrent filing : June 2005
I140 RFE : Nov 5th 2005

I140 approved : Nov 30th 2005
I485 RFE : Apr 13th 2007(latest employment letter)
I485 RFE replied : June 18th 2007
I485 approved : June 28th 2007

Wife got FP notice yesterday. None for me or my daughter. USCIS now has a new procedure where they will update the criminal background check without new fingerprints, unless old FP are unusable for whatever reason....That means no GC until end of July with all the remaining processing :(
Was hoping to be out of this agony earlier.......
Hopefully no retrogression in Aug.

And what if filed a concurrent I-140 and I-485.
Though this is my second I-140 and I am trying to capture an old priority date (and I do have the receipt from the old I-140).

Hello All,
I have been reading in a lot of posts that EB-2 option will be removed for Software people.
Can anyone provide me a link for it? I can't seem to find it.
Thanks

Can we go to local USCIS office and get new I94.Does that resolve the issue.
No, CIS local offices don't do this. There is no mistake on the I-94, so the only way to change it is as described in the prior answer.

I have the same question. What is the process of renewing once its already expired? Should a new application be submit? Can we do it on our own without going through a lawyer?
Thank you
I did it myself without a problem. It's the same I-765 form, you just mail a filled-out form, a copy of your existing EAD (front and back), copy of I-485 receipt, 2 photos and a check.

Hi
I am currently on H1b and I have applied for an extension around July 14th. My i-94 is expiring on
Sept 20th. My husband is currently on F-1. I wanted to find out in case my H1b visa is rejected, will
I have to immediately leave the country. Would it be possible for me to convert to F-2 while being in US
in case my H1-B gets rejected?

Unfortunately some of your water is blown out, which is a distraction. I also find the dead stick very distracting in this image of water and lush foliage. I did a little processing and cropping. See if you think it's better.

I am no attorney... but from my knowledge you are OK.
The h1b rules state that once you loose your job, you have 10 days to find another way to keep you in status or leave the country... and your situation, even if it comes to a point where you have to agree that you were out of job for that 5 days is no problem at all.
cheers...

My labor got approved in Jun 2006, I 140 approved in Oct 2007 and I am a July 2007 filer. My employer got a NOIR on I 140 saying this:
Please provide evidence that supports your answer to question 9; Part C (Employer Information) of the approved ETA 9089 processed in Jun 2006. "Is the employer a closely held corporation, partnership, or sole proprietorship in which the alien has an ownership interest, or is there a familial relationship between the owners, stockholders, partners, corporate officers, incorporators, and the alien?"
And then it lists, what could be the documentation to prove this relationship. My Employer is sure that he gave NO for that question but I am not sure. I am in parolee status working for the same employer on H1b. I do not have any kind of relation with the employer at any time.
What if the employer by mistake answered it as YES? what are my options, can I still fight? what could be the documentation, incase we answered NO to the question. Please help me what could be my options.
