Two reasons why this will take long time;
1. Multiple languages spoken in EU. Outside England, everybody prefers conversation in their native language. This will be big barrier for english speaking asian community.
2. UK did this experiment and failed. A lot of Doc's left UK to US, Canada and Australia.

So I won't suggest anyone to venture into EU. US is still the best place for foriengers and immigrants.

I was in the same boat and I can tell you that you have to pretty much depand on your company attorney. In my case it took 2-3 inch thick stack of documents to prove the relationship of the US company with its foreign subsidiary and if you are trying to get L-1A (multinational executive/manager), it will take another bunch of documents to prove your credibility, your existing status with the company as a manager/executive in the foreign subsidiary, your proposed role in the US company and a lot more. I guess it would be wise for you to let the attorney handle the case as you probably won't have much to do with the whole process. However, the positive news for you is that almost all of the well documented and properly filed L-1 petitions are approved by USCIS, and any experienced immigration attorney won’t have much of a problem getting you approved.:)

I am a resident working on H1b. Got married and wife joined me in July 2010.

1. First question in the ITIN form w-7 is: Reason you are submitting Form W-7. (there are couple of options)

Is the option in my case: "Spouse of U.S. citizen/resident alien"? (and it asks for the resident's i.e. my name and SSN.)

2. Item 6d. "Identification documents submitted" ?
Options are for passport, Divers License, USCIS documentation.

My wife has all the three. Her H4 visa is stamped and valid. What all should I submit?

HI,

I received a 500$ check for apartment referral , I am planning to give the entire amount to the person who took the apartment. I was wondering if during the tax return filing I should be reporting this as an income and if yes should I be deducting the tax amount from the 500$ as I will be paying taxes on it.

Can the lawyer ask for the missing form; and will it have to be done by the USCIS at the I-140 stage? I was under the impression that only the USCIS can do this?

Hi,

I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

1. Can non-profit H1 be transferred to regular H1?
2. While non-profile H1 is in extension process, can new regular H1 be filed?

Hello All,

When I was doing my education (MS) my credit dropped drastically and recently like 2 years back it went for collections too. However I cleared all my credit card debts but it still shows on the credit report that as severe deliquencies and number of open accounts.

Next month I'm applying for AOS - I want to know whether bad credit will have any affect of the approval or denial of the application? :mad:

Hi !
My husband just had his performance appraisal today. He is presently working as a Senior Consultant.What we are wondering is that if there is any change in the designation, will it affect the GC process in any way ?

We got our I-140 last month and EAD two weeks back.
Kindly advice us on this.

Until its the same kind of work, it wont effect the GC process. Your employer could send an ammendment saying that theres an appraisal.

I e-filed yesterday and the address came as USCIS Nebraska Service Center, as expected. My 485 is pending there and my previous EAD was also from NSC.

Where was your last EAD and 485 applied and processed at?

Has any one else experienced this? From the two posters above (which includes me) EAD and AP efiled applications went to National Benefits Center and generated the receipt numbers starting with MSC?

Please share your experience. Is there any thing to worry in this case?

Dear Friends,

I am some one might have gone through this situation. I tried to look for old post but couldn't find it.. Anyways

I have an Advance payrol, I went for Stamping at Chennai US counslate. They sent for Name check verification(Security Clearence). I have been living in US since 2000 and travelled back and forth many times and got visa stamped many times and they kept my passport and upon mailing they will send my passport.

My question is Can I use Advance Payrol while my H1B stamping case is sent for Name verification(security Clearence)..Please let me know any one has use AP in this case
