    Hi guys,

    My PD is current and my I-140 approved. I received below RFE on my pending I-485 related to my name listed differently on documents.

    RFE words are listed below.

    NAME DIFFERENCE:
    Submit documentary evidence to establish that Pravin Bhalla, Pravinkumar Bhalla and Praveenkumar Bhalla are the same person. The most persuasive evidence is photo identification in each name. If the last name is different due to marriage, submit the marriage certificate. Note: Affidavits will not be considered primary evidence.

    I don't have a lawyer for my I-485. Any help on how to answer this REF will be great help.

    Hi,

    They will allow you 30 minutes before your schedule appointment time.
    There is a lot of parking space before the office.FP may take around 30 minutes.

    My employer had applied 485 based on EB2. I have the approved ETA case number of the labor certificate and occupation code. My 140 is also approved. I have a US masters degree. I want to move on to a new company which has a minimum requirement of BS + 5 years (which will come under EB2).

    But I am not sure if he applied my labor as MS only or equivalent. He is not willing to reveal those details. Can you please tell is there a way I can find that out from the ETA case number?

    Hello:

    I was on H1B and was laid off last Thursday:(

    Now I am in the process of changing my status to H4 (my husband is on h1B), I heard the process takes 3-6 months. My questions hopefully someone here knows?

    1. Will I be able to travel overseas back home during this 3-6 months of waiting period?

    2. Can I apply for COS here in the U.S. and then go back soon afterwards and reapply H4 from the U.S. Consulate overseas when the COS to H4 is still pending here in the U.S?

    3. We don't plan to stay in our current address for more than 3 months now, can I use my friend's address on the form I-539 so when the COS is approved the notice can be mailed to my friend's home? Would it cause issues when INS notice that my address on Form I-539 is different from my previous on file?

    Hi,

    A couple of questions on the simaltaneous filing of I-140 and I-485

    1) I had read somewhere that USCIS was going to stop the same. Has that happened yet?
    2) Say a person has applied for the I-140 but cannot simaltaneously apply for 485 due to retrogression. In the event that the dates become current BUT the I-140 is not yet approved, can the person still file for the 485 under the simultaneous filing or does he have to wait till the I-140 is actually approved?

    Just want to share the info that i got from my immigration firm news letter


    Under Section 265 of the Immigration and Nationality Act (INA), all non-U.S. citizens who change their residential address are required to notify the U.S. Citizenship and Immigration Services (USCIS) within 10 days of the change. This applies to all adults and children (of any age) who are non-U.S. citizens, including U.S. green card holders.

    A person who fails to notify the USCIS of a change of address within 10 days of the change is guilty of a misdemeanor under Section 266 of the INA. The penalty for failing to notify the government of the new address within 10 days is a fine of up to $200.00 or possible imprisonment for a period not to exceed 30 days, or both. However, the government has not enforced this section of the law that rigorously to date, and many notify the USCIS of their change of address well after the 10 day reporting period without an issue, but this could change. Since we have seen an increase in USCIS enforcement activities with respect to H-1B employers and H-1B workers, and since many H-1B employers place H-1B employees at client locations around the country for short-term assignments, it is very important that H-1B employees notify the USCIS each time they move within the 10 day reporting period.

    In order to report a change of address to the USCIS you may download, complete, and mail a Form AR-11 or Form AR-11SR (Special Registrants Only) to the USCIS, or you may report your change of address, electronically, by visiting the USCIS web site (www.uscis.gov), and following the procedures provided by the USCIS

    Hello Bpositive,
    I am in the same situation as you are and have been for about 2 and a half months. I got a yellow slip and still awaiting feedback from the Consulate who in turn is awaiting a response from Washington.

    It depends on when you left the US and if you received your AP before your left the US.

    If you received the AP before you left the US then there is no risk in returning on the AP from what I have been told but if you did not receive it before you left the US then there is a risk of you entire AOS process being cancelled and this all depends on the officer and the situation at the POE.

    Unfortunately in my case I didnt receive my AP until after I left the US and am awaiting feeback from my lawyer regarding the rule in the link.

    Let me know if you find any other information
    as it would help me as well.

    Please..request that only those with personal experience with this respond. I have to decide in the next hour or so and have lawyer opinions already.

    Has anyone gone through this?

    My H1 is pending 221g admin process (Pink. possibly because I have a Phd in biology) I can't wait much longer as I may risk losing my job. Can I travel on my valid AP? I am not concerned about keeping my H1 status etc. My only concern is at port of entry. Lawyers have told me it is ok, but I would like to hear from people who have done this themselves.

    It's easy, I've been doing it all week long.

    Choose to export. When you do it comes up with a menu which lets you choose wireframe export. Also it allows you to choose which type of fills you want to use, as well as options for either the complete wireframe, or just the edges.

    I'll be posting my first example of interesting uses for this effect, tomarrow some time.

    I took an infopass appt for EAD pending more than 90 days. Both my EAD and my wife's EAD is pending for more than 90 days. Should I take 2 different appointments or can we both go in the same appointment.

    No matter how you feel about the alleged shortage, you have to acknowledge that the H1B gives the employer a remarkable amount of power over the employee's life. The employer bestows the right to live in the United States upon the employee, and often sponsers the employee's application for a green card. Changing employers is not impossible, but it is tricky and perilous.

    As an American, I can quit my job and become a contractor. An H1B can't. If my girlfriend decides to move across the country for a new job, I can quit my old job and go with her. An H1B can't. If I decide I'm tired of programming, I can quit and apply to law school. An H1B can't.     Unlike some of the posters here, I'm ok with the existence of skilled worker visas. But any increase should be off the table until basic human and economic freedoms are preserved for the worker. In America, you have the right to quit your job. Period. "

    Your mother must rely on the I-94 and file an extension if she wants to stay more than 3 months. The extension can be filed any time before the I-94 expires.

    My PD is Nov 24th 2005. EB2- India. Filed @NSC
    Dates are current for my priority date. Havent heard anything USCIS on the primary or derivative case.

    I opened a SR on 08/6th because the case should have been picked up based on their processing times. Haven't yet received any response on this.

    I want to schedule an infopass appointment however looks like we need to wait for 30 days from the date of opening an SR, before scheduling this appointment.

    Has anyone got slapped on the hand for not following this?

    I have also sought help from my senator, however no useful information has come out of it.

    Are their any other options available?

    Sorry to hear abt your case....it would help if you can share details of what happened and at POE what type of questions were asked and what was your response? what documents did the officer check? did he call your employer?Did they make you you sign on any papers? did they ask you to voluntarily withdraw your H1B petition?Please provide as much info as you can and I am sure IV core might also help you as this is the first time that someone came forward who is on H1B & got deported. All these days we are hearing abt friend and friends friend but nobody came forward first hand who got deported to share thier experiences...
