I was wondering if there are any plans for a recapture campaign ? my feeling is that we should concentrate on recapture at all times ..even if it is something in preparation i.e. do some homework now itself in anticipation ..the other point is keep talking about IV and get new members ..in the last 2 days ..I came across 2 people in various stages of immigration and they did not know about IV ..and they have joined now. I guess this is the most effective way to increase membership
well - we need money for lobbying and our funding drives are not going well. As nothing has happened on the legislative front, our members are not happy. But we must not give up.

USCIS has decided that the flowers sent by skilled, legal immigrants to director Dr. Emilio Gonzalez will be forwarded to injured service members recuperating at Walter Reed Army Medical Center and at Bethesda Naval Hospital.

The problem with IV core is they want to solve all the problems at once...which never going to happen... I really do not understand why they are not making this as an Action item and raise donations. let us make this sri1309 letter final and start sending it to congress (house, sensate members)

Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

I was a mostly passive observer during the S 1932 battle, and really admire all of your perseverance. I think all of you did very well with the limited time and zero funds that you had. A little bit about myself: I am a physician from India currently doing medical research here. I am currently busy interviewing for the medical residency Match 2006 (for those of you who know or care) and therefore will not be able to spend as much time here as I would like. I myself am not a GC applicant yet but am extremely interested in the cause you guys are taking up and want to see this thing being worked through. I believe our demands are just and fair, and perfectly in line with the American tradition of fairness. Our demands are just waiting to be intelligently articulated and brought to wider public attention, and will resonate well with all lawmakers irrespective of ideology. We will have to be careful about distinguishing our requirements from competing and confusing interests like illegal aliens, security issues and even H1B visa seekers.
No American, from the most socially conservative Republican to the scared-about-job-loss Democrat will grudge a legal immigrant -who has played by all the rules all the time and pays all taxes- to reduce his immigration wait period from 7 years to 2 years! We have to play on this sense of American fairness (which exists btw to those who are skeptical) and spread the news about our legit demands (and indeed our existence) to the wider American audience. We have to carry this issue from the arena of policy debate to the personal - tell Americans how it feels like for spouses to waste their time and hope, to not be able to buy a home or plan any kind of life beyond the wait period for the green card. We have to tell them that we are not just potentially controversial legislation, but real people, with dreams, hopes, fears and sensitivities- just like them. After all, we are a significant number among their physicians and software engineers, scientists and nurses, professors and graduate students.
But we should present these facts well to our audience, and not let communication glitches convert a no-brainer into a close contest. We should not let bad English or an unprofessional approach towards lawmakers/ media feed into stereotypes of “cheap labor” class peddled by the anti-immigrant groups. We have to be savvy and creative about our PR. We have to collect funds and organize the enormous mass of people affected by this issue. Among other things, we have to be politically sensitive and not pass judgments on illegal aliens or protectionist Democrats or anti-immigrant groups in our dialogue amongst ourselves or with others.
I am aware all of this is tall order, but if we can manage this, I think America will give us what we ask for inside of 6 months. Well, no - my basic argument is that the banks bloated up the 'real' asset value - I had the money then and I have the money now and I am still paying my monthly mortgage amount - the point is about the inflated housing prices.....with these banks knowing the actual value of the asset and still going ahead with the extravagant loans.
From another point of view, tell me 1 reason why would you lend out money to somebody who you know would not be able to pay you back?

They give you loan based on what you bid your house and it is all their fault. If only banks had refused the loan, you wouldn't have bought the house. Is this your logic? First let me state that I need people like you to proceed and hence I will be happy to answer the points you rasied to the best of my ability:
We all agree that there is severe backlog. Only way the backlog will alleviate is by increasing visa numbers, which not going to happen any time sooner.
So some people (and I know around 10 of them) what they are doing is the following:
They got the chance to file their 485 last July , which is pending. They are now contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...
This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that.Now you tell me , isn't that unfair to the people already in Eb2 line as well as the ones who do not know how to game the system
By the way: If any one is interested, I know of three such consulting firms that can do for you for a fee.

It is one thing to feel wronged seeing a few examples of people abusing the porting but quite another to have a lawsuit alleging that this is a widespread activity and it is causing grievous delays for the ones waiting in EB2. I really don't believe it and feel it is insulting to a large majority of highly skilled and hard working immigrants who have/will legally port their EB3 PDs to EB2.

Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.

I am currently working in Skilled visa through one of MNC company.I am working for this company for last 4 years and prior to this company i worked in another small company for two years.When I join my current company i provided all the legal document like exp,last two month pay stub and releiving letter and they did BG . They did not find anything wrong with prior employer in last 4 year. recently they found something wrong about my prior employer and asking me providing additional document and unfortunately company is closed or rename. I have told my current employer that i don't have any more evidance of my prior employer.Because of this reason they are asking me to come back india.
Is there any way that i can take legal action against this company in US because from last one week
they are harrassing my like anything.
Please let me know if anyone come across in this situation.
