We have received news from the American Immigration Lawyers Association (AILA) that they have reliable information that the July Visa Bulletin will be revised on Monday, July 2nd, or Tuesday, July 3rd. This Visa Bulletin is expected to retrogress many of the categories that were announced as being "Current" for July. It is expected that at least some of the categories will become completely "unavailable." The reason for this is that the USCIS apparently engaged in extraordinary efforts to approve cases in June, once there was some forward movement of the Visa Bulletin. They did this to try to avoid the tide of cases expected in July. Each green card approval uses one visa number. If the numbers are all used for the year, then the DOS will issue a revised Visa Bulletin reflecting "unavailable" in the particular category or categories.

My spouse is traveling to India soon as her father is ill. She is on H4 visa, valid until next year, with pending I-485. She doesn't have AP at hand. Given that there is a slim chance that our pds would be current, would she get into trouble if she is in India when her GC gets approved?:confused:

Contacting Senator seems to be the best option apart from POJ method..if there is some discrepancy from Service Request Response, you can clear that up from POJ method.
That said, even I am waiting for GC approval and needless to say, this wait is more frustrating than the wait before PD was current.

They should have your info unless consulate hasn't sent it. they use your passport number as reference. so call again if they didn't use your passport number to search. in any case ping the consulate again.

Actually this time I asked my friend in US to call DOS, and he used the computerized answering system with my petition number and they did say that my H1-B petition has been approved. I don't know if I mispronounced/mistyped anything when I did it last week, but at least now I'm sure that it is on DOS' system. Thats the same thing I heard when I called KCC, that my petition was approved in April 2007. Or maybe I should've asked them if they've access to PIMS. It's frustrating man, I never thought at this stage of career, entry-level that is, I will be stalled by things like this. Well I hope in the end I can find a rational explanation to why things turned out the way they did.
For the new folks in the forum, its been 75 days and am still waiting for my H1 visa. I guess I should also talk to that Mexican Emabassy and see if my case shows up on the PIMS or not. The only problem with New Delhi embassy is that when I call them, all they say is that the case is still pending, and nothing else. I don't even know if I should curse them for being incompetent, or maybe that is all their job entails (I'm not being condescending here). Is it advisable for me to go to New Delhi personally? This is a mess, but as long as its in God's design, I'm ok with it. I just don't wanna feel later that if I had done this ... blah blah, then I could've expedited the whole stuff. That'd be a bummer. Well at least I need to be focussed and keep my head straight. That I can control, and thats what I'm taking solace in.

BILL TUCKER, CNN CORRESPONDENT (voice-over): All H1-B visa workers do not look like this. Some even look like this. Most do work at technology companies, based on the latest data available from the government, data which is incomplete but revealing, nonetheless.
Five of the top six employers of H1-B visa workers in 2006 were Indian companies. They were issued 18,453 visas. In total, almost 20,000 visas issued in 2006 went to Indian outsourcing companies, and the data shows it was not American workers who benefited but foreign workers.
JOHN MIANO, ATTORNEY: According to the Bureau of Labor Statistics, between 2000 and 2005, the United States' employment for computer workers grew by about 332,000.
During the same time period, the United States imported about 330,000 H1-B workers for computer occupations.
TUCKER: The situation for engineers was even worse, with 95,000 H1-B visas issued in the same period for engineering, yet according to the Department of Labor, engineering jobs shrank by almost 124,000 jobs.
The visa is often referred to as being for the brightest and the best. But, the visa is broken up into four levels of classifications, with levels 1 and 2 being the lowest-skilled positions, and 87 percent of the visas went to those categories. WTF is he talking about 1 and 2? how can bachelors required masters required be lowest skilled positions?
RON HIRA, ROCHESTER INSTITUTE OF TECHNOLOGY: We really don't know whether those workers are working at level one. We know that they're being paid level one wages.
And what's interesting, at level one is if you look at the description of it, it's basically for interns, for people who have zero experience. From what I know H1 cannot be granted with Zero experience Am i missing something????

Lack of information is driving everyone in a chaos and people make mass calls frequently to get information. USCIS should be providing all basic information on cases on case status area of the website. This would reduce number of calls to USCIS and reduce such posts where each conversation with an IO generates some information and misinformation on forums. This feeds to rumors and incorrect information circulated on forums. While such information helps generate lot of threads, page views and ad revenue for other websites, As an organization we should be cautioning people about this.
On the donor forum we have posted some tips what you can do get your greencard. There is no need to make calls everyday trying to get status. If your application is outside processing time, you can simply open a service request. There are other options like Ombudsman and local Congressman's office. We have also posted to our members that if if you have tried all options everywhere and you are in a desperate situation, Immigration voice will help its continued donor members.
In my opinion posts such as "storage area, exam area, and where your file is, pre-approved" only drive curiosity and mass calls that will not help processing of your case. We as an educated and mature community should not fall for such information on the forums.

Another answer from Rajiv Khanna: on multiple 485s
I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.

This does not make sence at all. Why the USCIS would make visa number current then retrogress again? I do not think they make all visa current and not expect a flood of applications. .

WASHINGTON (Reuters) - Disgruntled green card applicants from India sent hundreds of flowers to the U.S. immigration agency on Tuesday to protest a recent policy flip-flop that hurt their quest for permanent residency.

The campaign that directed around a thousand flower deliveries to U.S. Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez was modeled on a popular Indian film promoting the peaceful protest methods of Mahatma Gandhi.
The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.
Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.
The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.
"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.
FLOWERS SENT TO SOLDIERS
Gonzales said in a statement on the USCIS Web site that the agency would forward the flowers to Walter Reed Army Medical Center and Bethesda Naval Hospital in Washington, D.C., the main facilities treating U.S. soldiers wounded in Iraq and Afghanistan.
"We welcome the fact that the director at least acknowledged this campaign and we are happy that our flowers will be bringing some color to our soldiers in those two medical hospitals," said Vikas Bajaj, a software developer in Wisconsin who helped organize the flower protest.
Although Indians staged the flower protest, the green card application setback affected skilled workers from China, Poland and many other countries.
Mundru and other activists said hundreds of thousands of people shared his state of limbo. Many were unwilling or unable to buy houses or start companies until their residency was secure, they said.
The situation of foreign professionals working in the United States while awaiting green cards was sidelined in this year's contentious immigration debate, which focused on illegal immigrants, Bajaj said by telephone from Wisconsin.
"We have never been in this country illegally, we are hard-working, we are skilled immigrants -- and yet very little space is devoted to our issues," he said.
"The irony is, in this whole migration debate, our issues are probably easiest to solve," said Bajaj.
