my 2 cents!!
if you are single and apply for 485 and get a EAD can still being ur wife from India on H4 as long as u DO NOT use EAD and DO NOT get 485 approved.
EAD to me has major benefits for the spouse. I think everyone agrees that 485 retrogression gona happen ... so if that happens u cannot get a 485 approval or add ur wife till almost close to 485 approval .. as ur PD wont be current. In this period u will never be able to use EAD as ur dependent will go out of H4 status ...
Also it is never recommended to use EAD and maintain H1 status ... so to me if you are single and have no plans as of yet to get married u will not use the interim benefits and pay EAD fee every year.
u will be in the 485 queue and if anything changes about green card u are atleast far enough to not to start ur application from beginning... also if for some reason u decide to use ur EAD the way around is ur wife to get another Visa like F1 ....

These consulting firms are really annoying. USCIS should try to close this loophole.
Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.
He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).
At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB

Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!
We need to let uscis know and audit all current and past approved cases from these consultants)

Was the H1B through a body shopper? I"ve heard of reopening all old cases of a company if they find a dubious H1B sponsorship, or if a company gets blacklisted.
If your company is solid and your case is genuine... you probably have nothing to worry about.

I convinced more people from my office to send a message on change.gov. Even US citizens who respect your work could send a message to the transition team saying that they are for the legal and highly skilled immigrants...
Getting recommendations from your bosses, managers and co-workers may also be helpful. Its very unusual for the USCIS/Immigration dept people to hear good things about the immigrants from US Citizens.
These days lots of people are talking about the transition at work and they know about change.gov website. If you know good friends who can write for you then that could be of great help.
I have a feeling that some good news is coming up in the pipeline. Was reading about Janet Naplolitano and Silos in today's NY times editorial.
Lets give it a best shot here guys..:)

I have applied for 485 and my PD is 2006, so out of question my date will be current soon but i would like to go back to india to take care of my parents and then when my PD is current I can come back.

Well, I have been waiting for over 5 yrs now. My case is a simple CP case, I was stuck in BEC, till June. The BEC wait frustrated me, so I had decided I would go for CP wouldn't like to wait for name check and the rest of the waits which comes with 485 filing. For that I had to forgo the luxury of EADs, AC21's and AP. Opted for CP during 140 filing, premium processing of 140 was still there during those times.Finished with that in 4 days and my file moved to NVC and from there to Mumbai consulate in October, and from then I've been waiting!!! Hopefully, I get an Interview date this April. And throughout the process I've been in this country, not India, since its EB category, so that aswers your question regarding moving back to India and coming back when PD is current.

What are the steps to follow to switch over to EAD, do i have to fill out some form and how do i i nform uscis ?

Our PDs are close.Mine is jul-06 eb3/I. My family's all 485s had a soft LUD on 03/31/2009 and today 04/01/2009. I am thinking it could be because of 2nd finger print notices for our family.

Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Often times it is evident that few IV members are struggling to keep a positive tone on the forums. As you may have experienced, it is easy to post few messages here and there. Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.

and you dont need 15 sponsors for a bill. and having 3 sponsors does not weaken the merit of a bill. in fact most bills would only have less than 10 cosponsors.
And it was in the democrats' rule that the last EB favored legislation was passed.

My situation: My wife still hasn't weaned off nursing completely.
My child is 1 year 3 months old. My wife got an RFE for TB test.
Plus she is in India currently.
Would sending the birth certificate of child be enough to prove the existence of 1 yr 3 month old child? OR would USCIS requires doctors's input also? OR do they require anything else to prove baby is still being nursed.?

I am speaking in my personal capacity here. While I am all for freedom of expression and assembly, I don't think that rallies will in any way help our cause. We have to talk to people and participate in various forums to make them aware of our cause. Standing and protesting is not going to help us, because our voice will still be lost in the din...we need to speak where it matters and be heard where it matters...

They either have to reject the application or provide the receipt notice. Cannot hold the applications without any actions for long time.
This can reduce the impacted percentage to people from Retrogressed Country /Category ...
May be some thing we can ponder on ....
