    Agree totally. If you look at the history there has been opposition to immigration. They said bad things about Italians, Irish and others. Some of the haters are once hated. But the life goes on !!!!

    I am a highly skilled professional working in this state providing a valuable service. I have a green card petition pending. Those like Lou Dobbs oppose migration of those of my kind, virtually any kind. Please tell me why? What do I tell my grateful patients, about this self acclaimed patriot?
    His is an agenda against all immigration. He just finds the most convenient arguments now against illegal immigration. Let me explain, I am on H1b visa, he criticizes that as well. My conclusion is he wants me to leave too. Ask him to name one kind of immigration he is for.
    His is an agenda against all immigration. I trust America can see past it. Recently I went to an upper end car dealership in Detroit to buy a car. The dealer there commented that if it were not for professionals like myself buying his cars, his dealership would struggle. I'm not sure why Lou Dobbs does not wish to understand that. He is certainly smart enough to do so. Perhaps he does not want to understand. He preys on the worst fears of people, instead of building on their optimism. That is not what got this country where it is. If this country were full of Lou Dobbs, frankly I would not want to be part of it. Fortunately, I believe it is not.

    I would recommend two forms of IV.

    1. Free for all (an immigration help site)
    Should contain:
    Information that are helpful for others. (Similar to what IV forum does today)

    Should not contain:
    Any information about our activities or agendas.

    2. A private registered member only site.
    Members of different state chapters should be members of this site. Users cannot register themselves on this site. Only state chapter leaders can enroll members.

    Should contain:
    Information about our activities, agendas, fund drive etc. Members can freely voice their opinions without unwanted visitors ( anti-immigrants ) viewing them.

    This would drive up the state chapter enrollment, meanwhile IV will still be a popular site for people seeking help.

    Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.

    One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.

    My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?

    Lastly this was NOT a threat nor was it intended to be a Threat that "take my advice or i will leave". Just a simple suggestion in light of things to come.

    I know you are not threatening to leave. But eventually some one will. It always happens when one or other item is included or excluded from agenda.

    Anyways, this isnt about looking weak or strong against anti-immigrants. That is really not the issue here.

    Its about how much we can have in our list of items. There is only so much anyone can do. Forget about us, even bigger organizations have priorities in order. Immigration Voice also has to have a priority. We cannot talk to anyone about fixing the H4 issues before the issues of retrogression are talked about. And we cannot talk about ALL OF THEM because there is room for only so much to talk about. There is a limit on everything. Limit on how much funds we have, limit on how much political capital does our lobbyist spend on our organization with lawmakers, limit on how much leverage the lawmaker uses to sponsor an amendment for us. No one has unlimited capacity to get things achieved. So in that sense, H4 issues really cannot be on the list. And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief. Now tell me, how is that not tied to H4s. EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.

    Well then why dont you picket against NumbersUSA, programmers guild et al too, i can name 20 conservative radio shows try emailing/talking them to change their opinion. I say this because i have emailed to a few and even tho they understand my point of view they will not change something that gets them ratings and propagates their cause.

    IV has 25k members, i guess 10% out of those are really motivated to participate and ready do something, if you start diverting your resources towards such issues your team will not have much motivation or people remaining when you really need them to do something. IMO

    Quoting Gandhi left and right is becoming pass� now, its like desi politicians, invoking Gandhi for everything. Gandhi did not oppose or pick a fight every monkey who was against indepedence, he was focused on getting the british out and by creating a mass awareness. Try not to take his name in vain. (this is not directed at your post, i have been following your well written posts for a while. It a general comment after reading the forums.)

    One step closer.

    With last year crisscrossing, EB2 India most apps are cleared upto september 2004. We should not have too many in 2004 except substitution cases.

    Hope it will step into 2005 in next 4 months....

    Yes, I guess the slowdown will happen when it hits the 2005 mark when PERM was introducted and a lot of EB3 were converted into EB2

    I don't mean to embarass you or make you feel awkward by thanking you every time you post, but the excruciating detail that you get into, in your posts, to back your statements never ceases to amaze me, and I know I speak for a lot of people here.

    That being said, if I may bother you with one more question.

    Lets assume that the 140 is revoked right after the employee leaves, and the employer had 100% abilitiy to pay the employee until that moment.

    6 months after the employee left, and after the 140 was revoked, the employer gets an ability to pay RFE on some other pending or unrevoked 140 of theirs. In that case ,can the 140 that was revoked 5 months ago be in danger?

    Of course, this is assuming that all AC21 memos till date are considered binding, and no memo changes to AC21 have happened.


    USCIS uses three criteria in deetermining ability to pay;

    1) net income is more then labor wage
    2) net current assets is greater then labor wage
    3) person is getting paid labor wage from date of filing labor

    #3 is the only one that does not have dependency on employer financials and the # of filings that a company may have done. If person wasn't getting paid labor wage from date of labor filing then dependency is on company financials and if there is adding up together then there is issues.

    If in 485 denial it is due to ability to pay and they state so in 485 denial and you were paid labor wage from priority date until you left and were eligible for ac21 then the denial would not have been in error and you would be fine.

    1. "PLEASE Put your real dates in your profile" There is no provision to put dates for CP filers!! All the dates are for 485 filers.

    Though it is proven time and again that CP filers are the least needed people on this forum (next to EB3 I - going by this thread), it is unfair not reserving few columns on the profile for CP filers ... It doesn't cost VISA numbers for that...

    2. I have told this before but would like to repeat now... I don't contribute because there is nothing for CP filers here. VISA recapturing is the only effort that would benefit CP filers but anyway the chances of that bill passing is close to 0.

    In my opinion, the biggest sufferers are people in EB3 India or China and who have opted for CP (now guys, don't start lecturing on CP vs. 485. We have heard it enough).


    Hi Will Win

    We all are immigrants in some way or the other standing in some line or the other. We need to be together . What IV is trying is to fix the system. If something somewhere gets fixed it surely benefits the immigrants and brings hope for other things that need to be fixed. Don't you think if the EB system here was fixed, IV would have been able to focus on CP ?

    We all need to stick together to help each other.

    I saw the poll in the morning and voted FOR making this a paid site, but going through the discussions and a little bit of soul searching (slow day at work :p) i am a bit wary about making it a paid site now.

    As much as i would like to see the riff-raff (pardon the expression) go away, maybe we should be more inclusive then exclusive (?). Not everyone is an early adoptor, it took me a while to contribute as well, but i did eventually turn around and contributed the lil bit i could.

    Thats just my take, and excuse the rather altruistic title of my post.

    You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.

    And what is this with so many reds besides my name..wat is this?? Ppl venting their own Frustration on others.

    Hi All,

    I want to share my exp. regarding visitor insurance for my parents.
    we took ICICILombard in india itself. My father has to see the doctor for
    a small procedure done on this toe. He developed because of injury as he is diabetic.

    And after reading so many negative reviews i was afraid whether i will get my 1200$ claim accepted or not. As i thought diabetes is a pre-existing condition.
    And we also mentioned it in the insurance policy when we took.

    But surprisingly we got the claim approved by ICICI Lombard last week and we got all the money (minus 100$ deductible).

    So it's better to have some kind of insurance (to be on safe side) if you think the patriot and KV Rao are expensive.
