Guys.. need your expert advice.
I am travelling next month out of the country for a week. I am currently on a valid H1B which is stamped on my passport but my 485 is pending and the dates are current. I also have a valid AP to use and return on.
Question i have is if i show my H1B visa at the port of entry and enter using that am i risking my 485 application in anyway?
Let me tell you the hypothetical situation i am talking about
lets say my 485 gets approved on sept 6th 2008 but has not been updated on the USCIS case status online. Also i enter the country on sept 6th 2008 on h1b status?
What happens then? do i lose my 485 status because the last status i enetered on 485???
Please gurus .. i really need to know if this is true? does coming on h1b invalidate your approved 485 ?

Nothing ever is super-fast. Certainly not the green card. You had your share of waiting. Its just that you suddenly see light at the end of tunnel and before you realize you are out of it. So it feels like a dream.

I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.
What happened to the IV's talk with USCICS on spillover policies? Does anybody know?

If we all unite and just fight for the cause of VISA recapture bill we all will get benefit, people i nthe backlog will be cleared and the people waiting in queue will be able to file their AoS and enjoy the EAD/AoS Benefits.

Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..
``(I) the employer with whom the H-1B nonimmigrant would be placed has not displaced, and does not intend to displace, a United States worker employed by the employer within the period beginning 180 days before and ending 180 days after the date of the placement of the nonimmigrant with the employer;
``(II) the H-1B nonimmigrant will not be controlled and supervised principally by the employer with whom the H-1B nonimmigrant would be placed; and
``(III) the placement of the H-1B nonimmigrant is not essentially an arrangement to provide labor for hire for the employer with whom the H-1B nonimmigrant will be placed.

I like your idea but the minimum is 50$/ month or 100$/ month.
Infact i like the idea of 5$/ month.
If 20,000 people donate 5$/ month = 1.2 million $/ year.
= 1 million $ (after loosing transaction charges)
So next step enable 5$/ month to 100$/ month RECURRING contribution arrangements ASAP.
To avoid transaction charges let users pay quarterly or half-yearly recurring.
i.e. if one wants to donate 5$/ month so it will be 30$/ 6 months etc.

I had a question for all on the eb3 to eb2 porting - once the new EB2 labor gets approved and one applies for I-140 lets say in premium processing with the interfiling letter - does one need to reapply for I-485 once the I-140 is approved for the Eb2 application? This is for many EB3 folks that have been waiting after having applied for for I-485 in 2007. Any insight will be appreciated.

Unfortunately, country of birth for PD determination is one thing that cannot change. It is ridiculous that a country like the US that promotes itself as a meritocracy and a country of second chances ties the fate of EB applicants to such an immutable parameter.
I understand that your priority date is based on country of birth. I have read that you can use your spouse's country of birth. What if you have nationality in a country for over 20yrs but born in India. My parents emigrated to Europe when I was three months old, and I was naturalised there. The spouse rule doesn't apply to me because my wife is born in India too. Is there a rule anywhere that makes you eligibile to file under a particular quota if you had nationality in that country for a VERY long time? I was told no, so throwing this out to the group for advice. No hopes that I will hear otherwise.

How about the following:
Some IO was just playing around at MySQL database prompt. Just browsing without modifying any data... but it was recorded as LUD.
They were training new IO's and showing them some old applications as examples. And it registered as fresh LUD's.
They were performing data-mining/archiving on some old apps...I say, unless and until you receive a letter from them, just chill and get back to worrying about retrogression :-)

I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.
When the Dept of labour can process PERM in generally 6-8 weeks or less and the USCIS can offer premium processing of 140 in 2 weeks or less, what the heck is wrong in expecting these large companies and law firms to get up off thier lazy slow procrastinating backsides and file within 45 days?
That said, in the final ruling I suspect they will make some modification to this time frame.

Friend of mine (to whom I contacted regarding IV) is in USA for 7 years and knows how lobbying & party funds are raised (including Watergate) and also very much aware of "Retrogression" and problems of being "Legal".
Also, he is aware of cause of IV and appreciate that but he is un-comfortable because whenever he login to IV, he noticed that:
- more than 40-50% respondents are talking about money/contributions & signatures showing how much they have contributed as of today,
- 10-15% are talking about blocking non-contributors(calling by Free Lunchers etc..),
- 5 % are Pseudo intellectuals (talking BIG but dont know immigration basics like - PD, issues of I-140/I485)
- 5% are always trying to shutdown others, accusing/calling by names to other forum members (he says "Highly skilled" in accusing!!)
- and remaining are "Positive" contributors for IVs retrogression cause (talking about - I spoke to senators office, can we arrange rallies, when to Fax/fliers, when State chapters are going to meet, posting excerpts from senate/CSPAN/News etc..)
Is our audience is so? Can we focus on our cause? pl be together like.. Like-Minded!!!
First of all We are not into any 'gate' here...We are not creating any 'watergate' or 'immigrationgate'...
All activities we do are legal and you would eventually get the expenditure report too...
Now If you try to build any organization that is non paid completely volunteer...basis, all kinds of things do creep in...
There is no avoiding that....
Your 'friend' has a very idealized version of public organization in his mind....
But the fact is that all public volunteer based organization(especially the ones so heavily populated by 'high skilled' ones) are going to be chaotic....
The only public organizations that are not chaotic are either the Chinese communist party or paramilitary organization like fire fighters and police departments..All other organizations are going to be how you described...the different %ges..
Now you have 2 choices.....
Choice 1. Try to work with the chaos and have some voice in the legislative process...
Choice 2. Shut your self out and not have a voice at all and mind you one less voice makes our collective voice weaker....
The choice is yours to make.........
