This was big surprize to me. Mine and my spuse had hard LUD on our I485 with the current status as :Notice Returned as Undeliverable. There wer no other updates or status change or approval or denial or soft LUD etc.
The most surpising to me that both of us received the Finger Printing notices on our new address just a month ago.
This is really frustrating.
When I called up the 800 number the lady said just ignore this status as this is some computer glitch.
Dont know what to do just believe her or try to do something else?
Need help ! any one out there in same situation???
I would suggest you not to take this lightly, though some IO on phone said so. I would suggest you to go for infopass ASAP

I talked to the FAO and they seem to understand my situation. I just want to see if my wife qulifies as 'Qualified Non-Citizen' because she has not used her EAD as of yet and neither I have used my EAD or AP.

Poor Coverage in Media Regarding a Very Important Issue where governmental agencies (USCIS/DOS) took unprecedented/unlawful route and resulted in millions of dollars wasted and dreams shattered of hard working, lawfully present Highly Skilled Immigrants.
My Question is why is media acting like an Ostrich on this issue? Answers anyone??

My Delhi Consulate Experience for my H-1B extention:
I am from Hyderabad but due to unavailability of appointments in Chennai consulate I applied through Delhi consulate. As a US Resident, I have an option of selecting any Consulate in India.
First they will check your DS 156 & DS 157 form when you are in queue to get in and also your application gets verified in a counter outside the main embassy and then you are let in, you can deposit your Cell Phones so don't leave your cell phones at home as we did, it was tough without a cell phone for half an hour after interview .
Once you get in into the embassy they do finger printing and then you are in queue to meet US Consular Agents.
While I was in queue, I saw lot of people getting rejected (mostly F1). They were asking unexpected questions to H1-B extension folks too. Questions like
1) Why did you change to this new employer?
2) How many employees does it currently have?
3) What does the company do?
4) How did you know about this company?
5) What was your masters in?
6) In my case they asked about names of the clients I was involved with through my IT services employer?
7) What are your job responsibilities?
They are trying to look at your body language and communication skills.
When I went to the counter he asked me about my previous company and current company, as mentioned above they asked me about how many clients I was involved with through my current employer. Then he said, he couldn't find my petitioner details online so he would check it and issue my visa if no further documents are required(I don't know what he meant by no further documents). I do not have my passport yet(12 Jan 09), I have submitted my docs on 9th Jan 09. I expect my visa to arrive sometime next week (hopefully). Regarding documents he did not look at any of my documents except for my passport and I-797.

Big 5 has their own internal queue. What they mean by 6 months is after 6 months they will put you in the queue.
For Desi consulting corp-corp, there are some tips by various attorneys including Attorney Khanna (immigration.com). Attorneys are suggesting how to maintain reporting relationship with employer. Follow those practices and consult a good attorney for more suggestions and I believe you should be fine

DREAM act just got shot in the heart but it's still alive. On September 22, 2010, Richard Durbin introduced the bill once again along with Richard Lugar.
I don't know what you mean by starting the GC process, you mean file I485?
As far as I know, your only options to get GC are:
-- DREAM ACT (which is not something you can control)
-- Marry a US Citizen (which obviously is something you can consider)
In the meantime, whatever you do, do not go out of the country.

I had infopass appointment 2 days ago to enquiry about name check status. You stand on the line the security guy check your infopass appointment confirmation letter, and verifies the appointment time. if it is > 15 min. then he asks you to come 15 min. before. The receiptionist calls the next person in line. Takes the infopass appointment cfrm letter, and ask for what is the purpose of the appointment. Once she verifies it, If she gives you a token then you will go inside and talk to immigration officer.

What are the requirements to port from eb3 to eb2 with just an i 140 approved? I am happy with my current employer. I have worked with this company for 5 years now. I have a master's from a well known university in the US. At the time of applying for gc, attorney and company advised to file in eb3.

I came in USA on H1 visa and continued in that status till 2008 (six years). Company A sponsored a green card for me in 2003 for a position different than the one on my H1B based on future employment opportunity/position. My I-140 was approved in early 2007 and after applying for my I-485, I got my EAD and AP in August 2007. However since I was working on H1B with another company at that time, which was valid till June 2008, I did not use my EAD and worked till my H1B lasted. As my H1B expired, my status while living in US as per my lawyer changed to AOS pending.
I took a couple of months off and visited India. Came back to US without a problem using my AP. Looked to start a business but did not succeed due to economic condition. I still maintained an honest intent to join the sponsoring employer when I get my GC and vice- versa with regard to the sponsoring employer. To earn living therefore, I joined another company for a couple months in a similar field using my EAD but did not use AC21 (as a full time primary job). That job did not last long and now I am again looking for employment opportunity.
I visited my lawyer recently with current situation and a few questions and he said I can be in deep trouble - being unemployed mostly since leaving my H1B status and having worked for another company for those few weeks in a job capacity that was a bit different than the one on my petition. He said I could be deported too if my luck is bad in this case. I request you to advise me whether what happened was really wrong and if I can correct it anyway? As corrective measure, my lawyer says that with immediate effect either I should join the green card sponsoring employer or find another employer with similar job offer (willing to port my Green card) - to avoid hard quuestions with USCIS. In this economy, nobody wants to take extra burden. But I spoke with my GC sponsor. He said the job is there for me like before and he is willing to write a letter of intent to hire me on permanent basis currently or in future if required to whosoever concerned but would prefer to wait a few months giving the crunch in business these days.
WHAT SHOULD I DO? Would the letter suffice the honest intent on both sides regarding the employment offer? Can I afford to take a little more time find a simmilar job? PLEASE SUGGEST.

I got 485 Card production order and welcome notice email yesterday . I am assuming that means I got PR . my company has filed for H1 -B extension last week itself . what will happen to that extension , do we need to revoke/withdraw that petition ?
has anyone being in this situation ?
