    Dear IV Members,

    If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
    As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
    If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

    If these numbers are correct then total EB-I pending applications are about 125K only. Thats less than one year of total quota and If USCIS work properly then this backlog can be cleared in one year (ignoring ROW for now). But thats not happening and backlog is increasing every year, especially for India.

    Howcome, USCIS reports that pending I-485 is 620249 as Jan'2009.

    Something is wrong. I wish we can get pending applications per year per category.

    The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.

    Does anyone here have experience with commodity trading?
    Can we trade in commodities on H1 or L1 status?
    Is it too risky like forex trading?
    Who are the online brokers offer commodity trading?
    Is there a minimum account balance / trade required every month or so?

    Pls share your experience. Thanks!

    how long after the soft LUDs did you get the hard LUD (RFE)?
    And what was the RFE for?
    I had a soft LUD on 3/19/09.
    Nothing has happened since.

    Same here. Applied for AP. Got a soft LUD on my I-485 on Mar 25, 2009, got my AP approved on Mar 26, 2009. Does this mean they checked my 485 application prior approving my AP? or are they pre-adjucating my application? Will wait for a week or 2 to see if i receive any RFEs.

    My PD is EB-3 I, Mar 2004 and no way closer to being current.

    Can I still work on existing H1?
    Which i94 valid(AP or H1)?

    How is that possible? Did you apply for H1 before you left this country and got the approval after you came? If so you have a problem because leaving the country when H1 is pending invalidates the application.

    If you had H1-i94 before you left the country. Why did you not turn it in when you at POE(xit)? You are required to do so. If you have not, you are supposed to send your old i94's to some place (I dont know where, check the web).

    Lets not argue, lets discuss, maybe I could agree with your views. So heer it goes, how is quota limits fair to anybody? I thought we are all equals, unless you think you are challenged in anyways - physically or otherwise, in that case I agree, you are 100% right, there must be a special quota for you. For all others who consider themselves to be equal shareholders to the free society, isn't preferential treatment for any set of people "wrong" and "unfair"? Just asking? I mean are we not equals, if yes, then there should be no quota for any country, if no and you think you are superior, which maybe true, then I should get preferential treatment, if no, and you think you are inferior or otherwise challenged in anyways, well, in that case yes, you sure should be treat better than others.... you know....

    So what do you think you are - equal? inferior? or superior? I mean it has go to be one of those, right?

    Ok, I will give you a weak analogy. See how Indian IPOs distribute shares when it is oversubscribed. The same thing goes here. Replace money by applicants and replace investors by countries, and you will get a sense as to why per country quota is implemented. I agree it is hard to digest the per country quota, but it is what it is. It is affirmative action if you will. It requires equality, but gives some buffer to people not properly represented (or run the risk of being overwhelmed by any single country).

    Anyways, have you every picked up the phone and called us to ask us what we are doing at that moment? What we did last week, what's our plan next week? You know, there is a phone number listed at several places on the website. That phone never rings. Oh yes, never. So who come you never seek answers where you can get them?

    We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.

    Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
    We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.

    So there, you have your update? If you want to know more, then call us on the phone.

    And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

    If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.

    Commodity trading is probably the most "fundamental driven" (as opposed to being driven by chartists) out of all trading activities I have seen. So theoretically, you are at the least disadvantage in commodities market against the big guys if you know your fundamentals right.

    However, the very reason there is less technical trading in that market - lack of liquidity - again works against the average Joe. The most liquid of them - the Crude Oil future in Nymex - has a minimum lot size of 10,000 barrels - worth about $60k now. Any smaller sized derivatives (think of miNY futures etc) - come with significant liquidity or transaction cost penalties.

    All in all, I personally think that a rational investor should prefer a market with the following criteria:
    1. As much liquidity as possible. A liquid market will make stop loss the least painful. If you are a rational investor - stop loss is your lifeline.
    Commodities market is not very liquid. The most liquid market in the world is FX - followed by equities.

    2. As little special advantages for the big guys as possible.
    The worst offender here is FX. Since these things are not traded in a listed exchanges - the big guys don't have to publish anything other than the bid and ask prices. Talk about a transparent price discovery. :confused: . Commodities market - specially the electricity market - used to have a lot of the opacity which benefited the big guys a few years ago. Some of the recent regulations have done away with much of this. I have personally worked on creating some of these so called "Chinese walls" mandated by new regulations.

    That's all of my 2 cents. :)

    Based on the responses I got (or lack of), and based on my research and calling around in last few days, I have come to following conclusions:

    * Buy only from US based company
    * Buy only comprehensive coverage plan, not fixed
    * Buy only from a reputed and licensed broker who has been in business for some time, who is willing to help even after the sale.
    * No body covers pre-existing conditions. Here and there, somebody is claiming to cover them in some cases up to some extent, but there is really no evidence or consistent past record of they having actually covered, at least I can't find any. Therefore, don't believe or expect that anyone would cover them, unless you are shown the proof and convinced otherwise.

    Above may not always be true or suitable for everyone, but that seems to be the general idea.

    I read this everywhere about buying from US based company but after going through the plans I don't really see any benefit. I think none of visitor plans are of much help.

    You can go for comprehensive plan and they will list some PPO network, but you cannot use that network for any illness other than likes of flu and diarrhea. Initially I was unders the impression that having PPO network would atleast help in getting negotiated rates for emergency treatment but after talking to them furthur, I found out that they won't provide negotiated rates for pre existing conditions. There is a comprehensive plan from Liason which provides small amount for pre existing but that is flat amount and they will not negotiate rates as it is not covered illness. Most emergencies ( stroke, seizure etc.) are always regarded as pre existing.

    As for ICICI lombard, I have not used them but they list that emergency situations will be covered. I understand it will be big hastle to get any money out of them but these US based companies won;t even consider these situations.

    Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments

    Your statements (above in bold) are contradictory. On one hand you don't want us to judge you but you return us the favor anyway.

    Let me be clear here. I was talking about people who come here whining about how they can't buy a house ONLY because of the gc/immigration laws etc. I am not talking about Joe the Analyst (nicely copied BTW :-))

    All I am saying is to stop whining and do better to withstand what you cannot change.

    BTW, I put 10% down on my house and I've got the usual commitments.

    Exactly true but hard to beleive. Think how much you know about your home country immigration. That should answer this question. Most of my american colleagues are suprised to hear

    1. It is risk to buy house? Why? I am on H1b visa. What is that?
    My wife cannot work? WHy? she is on H4? What is that?
    I cannot jump companies as my gc is in progress? Why? Will you get your gc in next three months? No.
    When you will get your gc? May be after 6 years or later.
    WHATTTTTTTTTTTTTTTT... WHY? etc etc

    They do not know anything and they do not care.

    Spot on. i think the anti-immigrants grossly magnify the hue and cry over H1-B abuses. Most americans dont know what H1-B is and nor do they care. The only immigrants they have heard about are the illegal kind. Ordinary americans are mostly indifferent to legal immigration. Politicians care first for their votebanks (present and future) and second for their sources of funding aka corporate lobbies. They are the ones who have the ability to make a difference.

    We need to cut all the negativity here on this forum and focus on things where we can actually make a difference in intellectual argumentative way.

    It is absolutely useless at this point to predict the visa bulletins when we have a fair idea that there is about 3 or so years worth of backlog for EB2 and possibly much more for EB3.

    This article shows a lot of research and thought process has gone into its making.

    Again today there is an LUD (10/15/2007) on the below quoted H1B petition. What is going? The status remains approval notice sent, however.

    This may not be related to this issues but I saw an update of 09/25/2007 on my H1 case with a previous employer whom I left in 2004. This case was approved in 2003.

    First step - Write to WWJ Radio and let them know your concerns about the airtime provided to such nativist views which will result in attacks against foreigners.

    Second, let's all call up/attend his show and dispute his views with facts, such as Presidents Economical report, DoL statistics on Full-Employment Economy. Lets corner him on issues such as collapse of the Social Security system if number of Tax payers decreases, and how does he intend to stop it without increasing Immigration as American fertility levels are currently below replacement levels. We can ask him if he proposes the Government should increase taxes instead which will place him on a sticky wicket.

    Agreed. As individuals you and me cannot make much difference. But as a determined perseverant group, we can bring about change. If Gandhi can sucessfully take on the mighty British Empire "where the Sun never sets" with just a loin cloth and a staff, We are better equipped with Megaphones and Placards! Agreed I'm not a Gandhi, but then neither is Lou Dobbs, the emperor of a mighty empire with millions of soldiers at his command.
