Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 4 weeks ago and it was received by them the next day(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.
Let me know if you have any advice - we have to have everything signed by this Friday.

Dear Sir/Madam,
My h1b status (and I94) is valid till 20 Feb 2010. Few days back I have applied for my h1b extention on PP after completing 4 years 6 months. My I140 got rejected couple of months back and I appealed on it, It is on pending now. Basically i am looking for an options if my h1b extention gets denied , can i appeal for h1b extention and get h1b extention based my I140 appeal. Are there any other ways to continue to work in usa? or Do I need to leave usa immediatly? if yes with in how many days?

Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.

My friend just forwarded me this link and it shows 1-jun-2006 priority date for EB2. For EB3 it still shows Unavailable. However US State website still shows old dates.

I made address changes to pending EAD renewal and I-485 yesterday in the afternoon for myself and spouse. Same day later in the evening I got email saying CPO for EAD renewal. This is a story of 8/20/2008.
I tried called 800 number and was told that they can't verify that address was successfully changed on the application.THey don't have access to personal information. They are asking me to take Inforpass to verify the address.
There is no LUD on either I-485 or EAD renewal after address change. Is LUD an indication that address change has been done? There are no infopass available for 2 months ( I will keep checking if somebody cancels )
Does anybody has any pointer as to how I can verify address change without infopass

The NJ team has taken the initiative to make more people aware of the situation our organization. As part of this initiative, the NJ team will be distributing flyers to visitors of the Bridgewater temple today starting at 11.30 am.
If you would like to participate in activities like this, please feel free to start a thread for your state/district and other volunteers can pitch in

The primary can keep working on H1. If you don't plan on changing your job, be on H1. If there is any issue with your application, then you are still on H1. If you are on EAD and your application is denied, then your EAD also becomes invalid.

In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.
