If PD is not current, they cannot accept the application, the just have to return the applications citing the same reason. If they accept the application they have to receipt it and if they reject, then they need to have qualified reasons for it... Not having available visas is not an acceptable reason to reject the receipted applications. It goes to shelves untill visa number becomes available... Note. if they receipt, they need to process EAD/AP and work on the application like any other.
This is my understanding..

For me 24 days passed I've not received any letter from USCIS.
I have received yesterday the reopened notification (11/15/2007), I am very eager to know the status of others who has already met the 30 day period. Please provide some feedback on your case status.

Hi Guys. I am trying to take an appointment in Jan. The earliest I can get is 11th in Kollkata. I have booking to travel to US on 26th. After listening to the delays here, I am confused where to go for stamping or return with AP.:confused::confused:
Please advise; guys who have been through stamping recently. Appreciate your feedback.
About couple of weeks ago my employer had arranged a, life after AOS with our attorney and in their presentation they clearly mentioned that if you have AP don't go for visa stamping waste cople of days of your life.
Correct me if my attorney is wrong and if there is any advantage in getting the visa stamped.

i call embassy every day...they say under processing..VO has your case/pp..
my DOS approval was most probably done on 29th jan..so its been 6 working days and still embassy is not giving a positive response..

While we all appreciate the contribution Aman has made for this noble cause and we are thanking him left and right on this forum, that is not the real appreciation of his sacrifice. Just saying thank you Aman; good job is not a real appreciation of his sacrifice by any stretch. If you guys really appreciate what Aman has done for us, please show your appreciation by making contribution. All H1 filings which now pay a fee of $1500 or $750 will be asked to pay $10000 or $5000.....It does not apply to the H1 exempt institutions....

Reverse brain drain will not happen with warning. But it is happening. I know 4 of my friends (Great guys) left US just because of the current immigration issues.
People might not take decission now, but when time comes, that happens all of a sudden, they will not protest or even inform any one, they just catch the plane. No one knows that it has happend.
But can you bring them back if you want. IMPOSSIBLE.
Also Imagin, US is in good situation (not really but OK.), so they are ignoring immigrants, imagin what happens if they want people tomorrow for their survival. With this background, I am sure that they are going to get only JUNK.

If any employer is minting too much and troubling a lot, make all necessary advances that one can physically produce, in such case once the person is approved with good status of Green Card one can sue the employer, that would be the right time to bring him to justice.

No I wouldn't. Get it from the your child's pediatrician since they know the case history and will be able to word it correctly. Remember that the letter from the pediatrician is the basis which the certified civil curgeon for USCIS will use to apply for a waiver if he/she thinks it is necessary.

Q.2) Q.1 raises Q.2. When the dates are no more current, is adding your spouse as a dependent on your 485 safe enuf for her to be considered for filing 485 and getting GC when the dates will be current in future.

Since there are ton of cases, one will not get FP in traditional 30 day but they will get it around 60-90 days (assumption based on ,immigration and immigrationvoice forums and comparing influx with 1999-2000 dates becoming current situation. Yes, i have taken into assumtion that there were 195K h1's that time )
Ok so it's september already and you got your FP! But you want to have a total period of 1 year without losing your pd or your file in queue.
If dates are current in August then rescheduling september FP will go to December/November at the best!
Then you complete the fp process and the average time is 8 months - considering the flood of applications and dates will definately hit retrogressing in Nov-dec, They will assign cut-off dates. lets assume they go back to where the dates were in May/June 07 , then ,you will need to see where you are in the queue. There are some creative ways of generating an RFE (without getting 485 rehected due to initial evidence)- but it's not recommended ;-).

You know what RFES for Z1 visa would be easy to answer than for H1B visa.

USCIS is not allowed to send RFEs for the mighty Z visa applicants. All they need is a letter from friend saying they crossed the border before Jan 1, 2007 and they will get the Visa with in 24 hours.

This bill is in House judicial committee for markup only. This bill is not tabled on house floor yet. Even after markup and voting, this bill still needs to be tabled on house floor. If it gets approved there, similar measure S3414 will be brought to Senate floor for voting.

i know its pretty lame, but what i would really like would be a regular black ipod, and i dont mean that u2 crap, with the wierd red and signatures on the back.
I like the red and black, but I don't like the signatures... I wish it was black all the way around the back. That would be perfect and it *might* actually make me want to get an ipod.
