I am sure many here like me have the same question. Why is that Macaca has to make sure that he answers every single post? Why is that he makes tricky comments (sometimes offensive) and expect everyone to join him? I am with IV for almost 8-9 months now and have contributed to my ability, financially as well as by being active on this forum. But lately I am seeing that Macaca person all over the forum. And frankly it is becoming little annoying now.
I beg the max because I don't think we can do anything without the lobbying firm and other lobbying activities by core, and the contributions are < 20% of the money required. Please convince me that I should stop begging because !@#$%& or explain how to beg when we have < 3% contributing members in 45 days. In other words, please resolve the begging issue (by possibly explaing that we don't need the lobbying firm and/or other things). This is question 1.

Absolutely not. AC21 only removs the per-country limit in any calendar quarter in which overall applicant demand is less than the total of available numbers. In the present calendar year, the overall demand is defenitely more than the total of available number and AC21 priviledges would not apply.

One of the approaches can be for state chapters to be involved and solicit donations from local members. I liked the idea for donations from immigrants who have already obtained green cards and online ADS from google as long as we do not overdo it. I am leaning more towards funding drives. For reasons that people in the process understand better than I do, I agree that the amounts cannot be disclosed. Hence it would be nice to have offline discussions or discussions on PMs on targets between state chapter members.
I for one am not for monthly payments or memberships. That just makes for exclusive organization and we want to be more inclusive.
I also had another important question we need to ask ourselves. Do we want to solicit funding or donations or participation? They are two very different things. Participation is not limited to monetary involvement but can include time and ability (designing banners, websites, writing letters et al.) donation.

The Supreme Court has ruled that the Congressional power to regulate naturalization, from Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]
In other words, the Constitution does not specifically mention immigration but based on the above, delegates power to the Congress to pass laws to regulate immigration. This Article of the Constitution also clarifies the part about rules for immigrants and quotas being set at the Federal level and not State level.
The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.

I'm sure there are some intelligent and caring lawmakers somewhere who listen to legal immigrants' plight. They don't seem to be in enough or meaningful numbers. Most are interested in either keeping their seats or serving a subsection of their community.
Again, I believe they are moved mostly by lobbyists and other power groups. I don't yet fully understand how much power IV can wield, but IV could be one such group.
Lawmakers care about high-skilled immigrants only because people like B. Gates, Compete America and such keep lobbying any and all the time.
BTW, I'm not at all short-sighted about this. I'm just more realistic about how things happen in Washington. Need proof: For example, look at the staffers on McCain's campaign. Most are lobbyists. Understanding how democracy works in America and commenting about it is what the real big picture is.

After all the "immigration" bills only benefit folks who don't vote immediately. But one of lawmakers duty is to build the next generation America, and "immigration" bills benefit next generation America. People got to understand this fundamental difference and stop being pessimistic about IV efforts.

PD provides twoway door, one for new people to apply and other for USCIS to approve pending cases. Having more applications pending (out of PD range) will not help USCIS to approve cases, they need to move the PD forward for more applications to become current and for them to approve some of them.
Most of the people who rushed into July-Aug 2007 where EB3 or EB2 India/China. Since EB3 is closed for the year they have to move the number of EB2 India/China to pick those applciations.

If these numbers are correct then total EB-I pending applications are about 125K only. Thats less than one year of total quota and If USCIS work properly then this backlog can be cleared in one year (ignoring ROW for now). But thats not happening and backlog is increasing every year, especially for India.
Howcome, USCIS reports that pending I-485 is 620249 as Jan'2009.
Something is wrong. I wish we can get pending applications per year per category.

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

And, I have also forwarded the link and my mail to all my friends who are waiting for green cards. More importantly, I have asked my relatives and friends, who are citizens or who have green cards, to pitch in and write for our sake.
My suggestion, should you agree with the above, is not only to write to your Congress members but also ask your relatives and friends to do likewise.

I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.
1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.
2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.
And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

EB3 India is in a bad shape because of lot of backlog. I do not see relief for people with latter PD in many years to come.
EB2 India is also not expected to have good movement for the next few months.
So people who spend time on sites to track are wasting their time in my opinion.
IV is people affected and not just core members. Core members , chapter leaders also have their own jobs that pays salary and life and each one of us can only devote so much time to IV. The best strategy for all of us is to work on resolving the problem and not leave it for others to deal with it.
What each member can do:
1- Take part in IV action items. We currently have a couple of bills. There is a slim chance with this bills if only we can get more cosponsors and get CHC support.
2- Raise awareness of IV. More members will mean more people will take part in our campaigns.
3- Contribute to IV. We have a funding drive that is currently begging for attention. With meager funds we cannot even afford to do our limited lobbying.
4- Be an active IV member: If nothing at else, be regular on IV. More visitors on IV means more revenue for IV from banner ads. This revenue is used towards lobbying and website maintenance expenses. Other sites with banner ads use that money for their own, but IV uses that money for lobbying. Several thousand visitors everyday means a good amount of money generated via ad revenue ( I could not believe it when I heard it the first time). If you like tracking, then use IV tracker and help make it successful. PLEASE Put your real dates in your profile.Money from ads on it will be used for our lobbying .
5- Develop state chapters furthers. members can get active and build their state chapters further themselves. It can be great for making friends and networking too. We want to develop this further and need member's help.

Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.
The Form for instructions for filling the complaint & the form is available at http://www.dol.gov/esa/whd/forms/fts_wh4.htm list of H-1B willful violators is available at http://www.dol.gov/esa/whd/immigration/H1BWillfulViolator.htm and the list of debarred employer's is http://www.dol.gov/esa/whd/immigration/H1BDebarment.htm
When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.
What exactly happens to them?
Are they under a watch list?
Many employers will open up a new company and operate?
Maybe employers are ready to deal with this ????

When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.
What exactly happens to them?
Are they under a watch list?
Many employers will open up a new company and operate?
Maybe employers are ready to deal with this ????

not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.
